中美校园事故侵权责任比较研究

【摘要】：校园侵权事故在哪个国家都会发生。中国与美国分别属于不同的法系,遇到相似的案件时,在处理方式上是否有相同点,美国有哪些值得我们借鉴的地方?我国在哪些地方做的更好? 本文着重研究未成年学生的校园侵权事故责任认定。首先综合介绍了美国校园事故侵权的法律渊源与司法现状。接着通过文献与案例阐述中美两国司法实践中校园侵权责任的归责原则、责任构成、侵权行为类型、责任形态及承担责任的范围。然后比较分析了中国与美国在审理此类案件过程中所适用的原则与处理方式上的异同。通过归纳、整理,找出我国目前在审理此类案件时的优势所在,了解我国法院目前审理此类案件相比较美国而言存在的不足的地方及美国的可借鉴之处。同时对美国社会上采取的法律之外校园事故补偿救济办法作了简单的介绍。最后提出几点建议,希望能为我国司法实践带来一些启示。
[Abstract]:Campus tort accidents will occur in any country. China and the United States belong to different legal systems, when faced with similar cases, whether there are similarities in the way of handling, what is the United States worth learning from? Where does our country do better? This paper focuses on the identification of campus tort liability of underage students. Firstly, it introduces the legal origin and judicial status of campus tort in the United States. Then, through the literature and cases, it expounds the judicial practice of China and the United States. The imputation principle of campus tort liability, The composition of liability, the type of tort, the form of liability and the scope of liability. Then it compares and analyzes the similarities and differences between China and the United States in the process of handling such cases. To find out where our country's current advantages in handling such cases lie. In this paper, the author tries to find out the shortcomings of Chinese courts in dealing with this kind of cases compared with the United States and the reference points of the United States. At the same time, this paper briefly introduces the methods of compensation and relief for campus accidents adopted by the American society outside of the law. Finally, some suggestions are put forward, hoping to bring some enlightenment to our judicial practice.
