滥诉之殇引发的再思考

【摘要】：正诉的利益解决的是受到侵害的权利或某项争议是否需要通过诉讼程序提供救济的问题,旨在防止司法资源的滥用;原告资格解决的则是起诉人的主体资格问题,旨在强调对起诉行为的保护。如果没有诉的利益,即使具备原告主体资格,仍然不能启动诉讼程序。陆案的裁判,实质是要通过规制滥用信息公开申请权和起诉权,矫治政府信息公开制度异化的状态,进而树立以规制权利滥用反哺权利保障之社会意识,以保障那些真正需要政府信息和司法救济的人们得偿所愿。
[Abstract]:The interests that are being sued resolve the question of whether the infringed right or whether a dispute needs to be provided with relief through the proceedings, in order to prevent the abuse of judicial resources, and the plaintiff's qualification solves the question of the subject's qualification of the prosecutor. The purpose is to emphasize the protection of prosecution... If there is no interest in litigation, even if the plaintiff is qualified as the subject, he can still not initiate the proceedings. The essence of the decision of Lu case is to regulate the abuse of the right to apply for public information and the right to sue. This paper corrects the dissimilation of the government information disclosure system and sets up the social consciousness to regulate the abuse of rights and the protection of the right to feedback, so as to ensure that those people who really need government information and judicial relief can get what they want.
