我国建筑行业安全生产监管法律问题研究

【摘要】：随着城镇化进程的不断加快和延续,我国正在进行着世界上规模最大的基础建设,投资规模逐年加大,安全生产监督管理工作也面临着前所未有的挑战。尽管我国已从立法和执法两个方面,对建筑施工安全生产监管采取了不少措施,但每年的建筑安全生产事故仍在频繁发生。因此,对我国建筑安全生产监管工作进行深刻反思,对监管所涉及的各类法律问题进行广泛探讨,刻不容缓。论文首先阐述了当前我国建筑行业安全生产监管的基本模式和主要内容,研究分析了我国建筑行业安全生产监管方面现有的法律规定和特色制度,从立法和执法两个角度,指出了相关监管责任主体在监管过程中存在的问题与不足。分析发现,我国对建筑安全生产相关监管主体的职责有待进一步明确,建设行政主管部门、安全监督管理部门和其他监管机构的监管职责有待进一步落实。对此,论文从加强建筑安全生产监管法律体系建设、创新建筑安全生产监督管理的方式与角度、推动促进社会各界参与建筑安全生产监管等几方面提出了解决对策与建议方向,以此确保我国建筑安全生产监管工作取得实效、落到实处。
[Abstract]:With the continuous acceleration and continuation of the urbanization process, China is carrying out the largest infrastructure construction in the world, and the scale of investment is increasing year by year. The supervision and management of production safety is also facing unprecedented challenges. Although our country has taken a lot of measures to supervise construction safety in terms of legislation and law enforcement, However, the accidents of construction safety still occur frequently every year. Therefore, the supervision of construction safety in our country is deeply reconsidered, and the various legal problems involved in the supervision are discussed extensively. First of all, the paper expounds the basic mode and main contents of the construction industry safety supervision in our country, studies and analyzes the existing laws and regulations and the characteristic system of the construction industry safety production supervision in our country. From the point of view of legislation and law enforcement, this paper points out the problems and shortcomings of the subject of supervision responsibility in the process of supervision and control. The analysis shows that the responsibilities of the subject concerned in the supervision of construction safety in production need to be further clarified, and the administrative department in charge of construction is in charge of construction. The supervision responsibilities of safety supervision and management departments and other regulatory bodies need to be further carried out. In view of this, the paper tries to strengthen the construction of the legal system of construction safety production supervision, and to innovate the way and angle of construction safety production supervision and management. In order to ensure the actual effect of construction safety supervision in our country, the author puts forward some countermeasures and suggestions to promote the participation of all walks of life in construction safety production supervision.
