土地政策与法律治理:我国农村依法治地路径模式博弈

【摘要】：我国农村土地改革与治理形成了"政策先导,立法跟进"的传统路径模式,具有自身的深刻原因和相对优势。但政策与法律在农村土地上的博弈与交互调整也出现了法律的滞后性与政策的易变性以及二者的适用冲突等问题。全面推进依法治国意味着农村土地改革与治理应在法治的轨道内进行,需要在"法治改革观"导向下形成"适时立法,试点先行"的特色路径模式,对农村土地改革进行适时立法或修法,实现法律对实践的积极回应并降低政策的不稳定性,对展开的试点依据法律程序获得法律授权,取得在形式上的合法性,凸显农村土地治理与改革中深度蕴涵的法治应有之义。
[Abstract]:The rural land reform and governance in our country has formed the traditional path mode of "policy leading and legislation following up". But the game and mutual adjustment of policy and law on rural land also have the problems of lag of law, variability of policy and conflict of application between them. The rule of law means that rural land reform and governance should be carried out on the track of the rule of law. Under the guidance of the concept of "rule of law reform", we should form the characteristic path mode of "timely legislation, pilot advance", legislate or amend the rural land reform in good time, realize the positive response of law to practice and reduce the instability of policy. On the basis of the legal procedure, the pilot project can obtain the legal authorization, obtain the legitimacy in form, and highlight the significance of the rule of law deeply implied in the governance and reform of rural land.
