土地征收制度中农村集体土地发展权的配置

【摘要】：伴随我国经济的迅速发展,城市化进程逐渐加大,城市扩大建设需要更多的建设用地,必须以土地征收来助一臂之力。土地征收与农村集体有着紧密联系,土地征收的合法、合理运转直接影响广大农民的合法权益,以及今后的生活状态。轰动全国的“平度征地事件”正反映了我国土地征收的现实问题,这些问题真实存在需要引起慎重思考,土地征收为什么会造成血案?平度征地只是我国土地征收现状的缩影,本文梳理了国内土地征收的典型问题：利益配置失衡和正当程序缺乏,笔者就问题分析了其中原因,即是我国集体土地权利的缺失,土地征收产生的土地增值收益权利没有在法律中明确规定,致使现阶段的征收表现为政府补偿给农民基本的土地原有价值,自身获取丰厚的土地增值利益。本文以域外的农地发展权为基础,结合国内学者的农村集体土地发展权的研究,从农村集体土地发展权的基本内涵、权利归属和其价值、可能性三方面论述,为土地征收制度的改进提供理论基础。本文的重心是农村集体土地发展权在土地征收中的介入,由于我国没有此权利的相关规定,若想在国内良好的运行集体土地发展权,笔者提出了设置的基本原则,在基本原则的前提下运用农村集体土地发展权的权利价值改善土地征收补偿制度和正当程序,为接下来土地征收规范行使,保障农村集体及农民的正当利益提供理论辅助。
[Abstract]:With the rapid development of China's economy, city urbanization gradually increased, the city expanded construction need more land for construction, land expropriation must be to help a helping hand. Land expropriation and rural collective land expropriation is closely linked, the legitimate, reasonable operation directly affect the farmers' legitimate rights and interests, and life in the future. Sensational "event is a reflection of the flatness of the land" problems of land expropriation in our country, the real problems caused by land expropriation need careful thinking, why would cause murder? The flatness of the land status of land expropriation in China is only a microcosm, this paper reviews the domestic typical problems of land Expropriation: unbalanced allocation of interests and lack of due process. The author analyzes the causes of problems, that is our lack of collective land rights, land expropriation and land value-added benefits right in the law Clearly defined, resulting in current collection performance for government compensation to the original land farmers basic value, their access to land value profitable. On the basis of farmland development rights overseas, based on the rural collective land development rights of domestic scholars, from the basic connotation of rural collective land development rights, the rights of ownership and its value, discusses the possibility of three aspects, provide a theoretical basis for the improvement of the system of land expropriation. The focus of this thesis is the rural collective land development rights in land expropriation in the intervention, because the relevant provisions of our country do not have this right, if you want to run in the collective land development rights of the domestic good, the author puts forward the basic principles set and use the rural collective land development right in the premise of the basic principles of the right value to improve the compensation system of land expropriation and the proper procedure for the next specification for the land expropriation, It provides theoretical assistance to ensure the legitimate interests of rural collective and farmers.
