【摘要】：新《食品安全法》中的"行为规制"属于"权力性规制",具体分为行政许可规制和日常监管规制两类。行政许可规制有"应当取得许可"、"无需取得许可"、"没有明确规定"三种情形;日常监管规制分为风险管理和过程监管。通过原理分析和实效分析,可以定位新法的不足,为行政执法提供补充。
[Abstract]:The "behavior regulation" in the new "Food Safety Law" belongs to the "power regulation", which is divided into two categories: administrative license regulation and daily regulatory regulation. The administrative license regulation has "should obtain permission", "no need to obtain permission", "not clear" The "three circumstances" are indeed stipulated; The regulation of daily supervision is divided into risk management and process supervision. Through principle analysis and actual effect analysis, the deficiency of the new law can be fixed, and the supplement of administrative law enforcement can be provided.
