行政自我评价法律制度研究

【摘要】:近年来,由于政府职能的转变以及行政自制理念的不断渗透,行政法学界以及行政主体内部对于行政权力规范的要求也在逐渐增强,因此,建立一套属于行政系统内部的、能够对行政权产生良好的规制和限制作用的评价制度就显得尤为迫切,而行政自我评价由于自身的理论属性和实践操作性也对于现代行政法的需求表现的非常契合。具体来说,行政自我评价是一种通过发掘行政主体自觉性自律性,通过规定详细的内容和程序,通过多种形式的控制由行政机关对自身以及同类主体发起评价和自我评价的法律制度。从目前我国的实践来看,对于行政权的控制主要表现为外部方式,而这种形式对于行政权力并不能进行根本上的规范,这就需要一个强有力的内部控制渠道从行政行为的发起、实施一直到结束进行全程的检视和评估。因此,通过研究和学习国外先进行政自我评价理论要求和制度设计,从而建立适合我国现状的自我评价制度是一个极具意义的研究课题。 本文首先从界定行政自我评价有关概念为出发点,分析目前行政自我评价的内涵和具体分类,系统的研究部分发达国家行政自我评价的具体制度设计和程序安排,合理借鉴和有效利用,并且结合我国目前行政自我评价的发展现状及存在的问题,提出构建具有我国特色的行政自我评价法律制度体系。 国外的行政自我评价法制都带有自身条件的鲜明特征,在借鉴宝贵经验的同时,我们必须以自身的社会条件、文化特性等为基石来明确我国行政评价制度具体建构的方向与内容。因此,首先要明确界定行政自我评价法律制度的主体选择,因为评价主体的选择直接决定着评价对象的确定、评价的具体内容、评价的方式选择等;其次,要深入研究行政自我评价法律制度的具体内容,,包括对行政法规和政策的评价、对行政机关业绩的评价、综合各项指标的评价和对公务员的单独评价,其目的是将行政主体的一切行政活动都能够纳入到行政自我评价法律体系中;最后对行政自我评价法律制度的程序和方式,评价结果的公开和应用等等进行具体的细致化的统一研究阐释。这样才能切实贯彻行政责任化,实现行政效率化和质量化,真正贯彻落实行政自我层面的具体评价体系。
[Abstract]:In recent years, due to the transformation of government functions and the continuous infiltration of the concept of administrative self-control, the requirements of administrative power norms in the field of administrative law and the administrative subject have been gradually strengthened. Therefore, the establishment of a set of administrative system belongs to the internal. The evaluation system, which can regulate and restrict the administrative power well, is particularly urgent, and the administrative self-evaluation, because of its own theoretical attribute and practical maneuverability, is very suitable for the demand performance of modern administrative law. Administrative self-evaluation is a kind of self-discipline through the discovery of administrative subject consciousness, through the provision of detailed content and procedures. Through a variety of forms of control, the administrative organs initiate evaluation and self-evaluation of themselves and similar subjects. From the current practice in our country, the control of administrative power is mainly manifested in external ways. However, this form does not fundamentally regulate administrative power, which requires a strong internal control channel from the initiation and implementation of administrative action to the end of the whole process of inspection and evaluation. It is a significant research topic to establish a self-evaluation system suitable for the present situation of our country by studying the foreign advanced administrative self-evaluation theory requirements and system design. This paper firstly analyzes the connotation and classification of administrative self-evaluation from defining the related concepts of administrative self-evaluation, and systematically studies the specific system design and procedure arrangement of administrative self-evaluation in some developed countries. Based on the current situation and problems of administrative self-evaluation in China, the author puts forward a legal system of administrative self-evaluation with Chinese characteristics. The legal system of administrative self-evaluation in foreign countries has its own distinctive characteristics of its own conditions. While drawing lessons from valuable experience, we must use our own social conditions as our own. Cultural characteristics are the foundation stone to clarify the direction and content of the concrete construction of the administrative evaluation system in China. Therefore, first of all, it is necessary to clearly define the choice of the subject of the legal system of administrative self-evaluation. Because the choice of the evaluation subject directly determines the determination of the evaluation object, the concrete content of the evaluation, the choice of the evaluation method and so on. Secondly, it is necessary to deeply study the specific content of the legal system of the administrative self-evaluation, including the evaluation of the administrative regulations and policies. The purpose of the evaluation of the performance of administrative organs, the comprehensive evaluation of various indicators and the individual evaluation of civil servants is to integrate all administrative activities of administrative subjects into the legal system of administrative self-evaluation; Finally, the procedures and methods of the legal system of administrative self-evaluation, the publicity and application of the evaluation results, and so on, are studied and explained in a concrete and meticulous way. Only in this way can the administrative responsibility be effectively carried out, and the administrative efficiency and quality be realized. Truly implement the administrative self-level of the specific evaluation system.
