行政性立法过程中的协商机制探讨

【摘要】：行政性立法与民众生活关系密切,立法中民众参与的愿望也更强烈,立法协商的开展也相对活跃。就我国现有行政性立法中协商因素的法律规定及其实施效果看,还存在协商视角不够全面,公众立法参与的权利赋予不实、保障不尽充分,以及公众参与的程序规则简陋、随意性太大等问题。对此,还需要妥善分配部门立法权,加强部门之间的立法协商;加强公众立法参与权的法律保障,明晰其在立法协商中的法律地位;细化立法听取意见程序规则,完善反馈机制;完善和精进网络信息平台,为立法参与活动创建更广泛和便捷的平台,由此才能使协商机制更好地发挥作用,也才能更真确地在立法中反映民意。
[Abstract]:Administrative legislation is closely related to the people's life, and the desire of the people to participate in the legislation is stronger, and the legislative consultation is also relatively active. In view of the legal provisions of the consultation factor in the existing administrative legislation of our country and its implementation effect, There are also problems such as inadequate consultation perspective, inadequate right to participate in public legislation, inadequate protection, poor procedural rules for public participation and too much arbitrariness. To this end, it is also necessary to properly allocate the legislative power of the departments. Strengthen the legislative consultation among the departments; strengthen the legal protection of the public's right to participate in legislation, clarify its legal status in the legislative consultation; refine the rules of the legislative hearing procedure, perfect the feedback mechanism; improve and refine the network information platform, Only by creating a more extensive and convenient platform for legislative participation can the consultation mechanism play a better role and the public opinion be reflected in the legislation more truthfully.
