不动产登记视角下的土地经营权探析

【摘要】：正农村土地改革的核心,是如何从土地承包经营权中分离出土地经营权,并对土地经营权进行准确的定位。2014年12月出台的《不动产登记暂行条例》第5条规定,"法律规定需要登记的其他不动产权利,依照本条例办理登记"。在不动产登记视角下,土地经营权属不属于"法律规定需要登记的其他不动产权利"?内涵和性质如何?笔者拟对一些相关内容进行探析。土地经营权的主体按照农地三权分离的改革思路,土地所有权归集体,土地承包权归农民,土地经营权归新型农业经营主体。按照官
[Abstract]:The core of the rural land reform is how to separate the land management right from the land contractual management right. Article 5 of the interim regulations on the Registration of immovable property, issued in December 2014, stipulates that "other rights of immovable property required by law to be registered shall be registered in accordance with these regulations". Land management right does not belong to "the law requires registration of other real estate rights"? What is the connotation and nature? The author intends to analyze some related contents. The main body of the land management right belongs to the new agricultural management subject according to the reform idea of the separation of the three rights of farmland, the ownership of land belongs to the collective, the right of land contract belongs to the farmers, and the right of land management belongs to the new type of agricultural management subject.
