【摘要】：草原是地球生态环境平衡不可或缺的组成部分,草原资源是人们满足自己生活需求的最直接供给。蒙古国的草原对蒙古国人民的发展,甚至对生存起着决定性作用,是蒙古国人民赖以生存的土地资源。有效管理草原资源和保护草原环境,关联着蒙古国人民的发展和衰落。因此,蒙古国极其地重视草原的保护,无论从民族习俗习惯到法律制度,都有其较早的历史。经过研究和查阅资料后,本文中笔者把蒙古国草原保护分为对土地的合理利用和对草原生态保护两大种类进行研究,并在此基础上以自然地理条件较为相似的内蒙古为例对比我国的草原保护法律制度,分析蒙古国草原保护法律制度对我国的启示。本文以四个部分为内容重点介绍蒙古国草原保护法律制度。第一部分主要通过阐述蒙古国草原生态环境的概况,包括自然环境、社会生活和自然生态退化的现状,说明蒙古国现行的草原利用方式及其利用当中产生的草原环境问题;第二部分则以时间点为分界线,从三个层面分析蒙古国草原环境保护法律制度的演进,详细地说明蒙古国草原环境保护法律制度的产生和逐步完善的过程;第三部分则为本文重点介绍的内容,简单说明蒙古国草原利用制度的基础上,详细介绍蒙古国现行的草原环境保护制度的具体内容及其实施现状;文章最后一部分分别从草原环境保护和土地合理利用两个方面分析蒙古国在草原保护对我国草原保护的启示,望对我国草原保护法律制度的完善提供些许的帮助。
[Abstract]:Grassland is an indispensable part of the balance of the earth's ecological environment, and grassland resources are the most direct supply for people to meet their living needs. The grassland of Mongolia plays a decisive role in the development and even survival of the people of Mongolia. The effective management of the grassland resources and the protection of the grassland environment are linked to the development and decline of the Mongolian people. Therefore, Mongolia attaches great importance to the protection of the grasslands, Whether from national customs to legal system, there is an early history. After studying and consulting data, the author divides Mongolian grassland protection into two kinds: rational use of land and ecological protection of grassland. On this basis, taking Inner Mongolia with similar natural geographical conditions as an example, the legal system of grassland protection in China is compared. This paper mainly introduces the legal system of Mongolian grassland protection in four parts. The first part mainly introduces the general situation of Mongolian grassland ecological environment, including the natural environment. The present situation of the degradation of social life and natural ecology illustrates the current grassland utilization patterns in Mongolia and the grassland environmental problems arising from the use of the grassland; the second part uses the time point as the dividing line. This paper analyzes the evolution of Mongolian grassland environmental protection legal system from three aspects, and explains in detail the process of the emergence and gradual improvement of Mongolian grassland environmental protection legal system. The third part is the content of this paper. On the basis of briefly explaining the system of grassland utilization in Mongolia, this paper introduces in detail the concrete contents and implementation status of the current grassland environmental protection system in Mongolia. In the last part of the article, the author analyzes the enlightenment of Mongolia's grassland protection on grassland protection from two aspects of grassland environmental protection and land rational utilization, and looks forward to providing some help to improve the legal system of grassland protection in China.
