论民族地区教育立法的特色及其彰显

【摘要】:民族地区教育立法特色体现的是教育发展规律映射在法律制度上的特色规定、民族地区社会经济现状映射在教育发展路径上的特色要求,以及中央层面教育法律法规映射在民族地区的特色需要。从现状看,民族地区教育立法特色具体表现在立法主体特殊性与民主性的统一,立法依据从属性与创新性的协调,立法过程排他性与公开性的交融,以及立法内容动态性与引导性的契合。特色视角下民族地区教育立法需要回答民族教育地方法律功能如何发挥、不同教育利益群体冲突如何消解、民族地区人民群众自主发展教育事业的积极性如何激发、民族地区教育立法的统一性与变通性如何协调等复杂问题。基于此,民族地区教育立法需要遵循底线原则、适度原则和实践性原则,进一步彰显立法特色,为民族地区教育事业发展提供更有力的制度保障。
[Abstract]:The characteristics of educational legislation in minority areas reflect the characteristics of the laws of educational development mapped to the legal system, and the special requirements of the social and economic situation in minority areas in the path of educational development. From the current situation, the characteristics of educational legislation in minority areas are embodied in the unity of the particularity and democracy of the legislative subject, the coordination of the legislative basis and the innovation. The combination of exclusiveness and openness in the legislative process, as well as the combination of the dynamic and guiding contents of the legislation. Such complicated problems as how to resolve the conflicts of different educational interest groups, how to stimulate the enthusiasm of the people in minority areas to develop educational undertakings independently, and how to coordinate the unity and flexibility of educational legislation in minority areas. Education legislation in minority areas should follow the bottom line principle, moderate principle and practical principle, further highlight the characteristics of legislation, and provide more effective system guarantee for the development of education in minority areas.
