基层治理法治化的经验依赖与理性建构——以劳动纠纷治理的规则体系建构为例

【摘要】：基层治理是治理理论与基层问题之间的关联。基层问题是一种与国家权力相对应的基层权力配置的问题。在国家治理现代化背景下,基层治理法治化命题的价值在于为治理和法治提供路径,主要表现为经验主义和理性主义的双重路径。以较为典型的劳动纠纷治理之中的规则体系及其系统化建构为例,经验依赖和理性建构两种路径为劳动法体系的系统性推进即劳动法法典化提供了认识的思路和内容建构的框架。经验主义和理性主义作为两种基层治理法治化的路径具有一般的意义和普遍的价值。
[Abstract]:Grass-roots governance is the connection between the theory of governance and the problems at the grass-roots level, which is a problem of the allocation of grass-roots power corresponding to the state power. The value of the proposition of rule of law in grass-roots governance lies in providing a path for governance and rule by law, mainly manifested in the dual path of empiricism and rationalism. Empirical dependence and rational construction provide the framework of understanding and content construction for the systematic advancement of labor law system. Empiricism and rationalism as two kinds of grass-roots governance legalization. Path has general meaning and universal value.
