信赖保护原则的法律化研究

【摘要】：诚信政府建设现已在全社会予以展开，诚信政府建设的过程是离不开社会制度的支持与保障，而信赖保护原则则是构建、保障诚信政府建设最有力的法律制度。信赖保护原则在行政法域中的适用，要求行政主体对行政相对人所作出的任何承诺、行为都应保持其存续力，不得擅自改变已生效的行政行为，不能任意改变已有行政行为所生成的法律状态或秩序，以确保相对人信赖利益能得到最大之保护。信赖保护原则作为外来的法律制度被引入我国的时间并非较长，学术界对其研究也存有不同的理论体系，但该原则在我国的发展还是较快的。在1999年的司法实践中就有体现信赖保护精神的司法裁判，特别是2004年《行政许可法》的颁布实施，开创了我国信赖保护原则的立法先河，该法律文本多处吸收了信赖保护原则的法治内核。除《行政许可法》外，《全面推进依法行政实施纲要》、《湖南省行政程序规定》及《行政程序法》（试拟稿）草案等也都有体现信赖保护精神的法律条文，信赖保护原则在我国的法制化建设已初现成效。 当然，一项法律制度被移植到一个新的法域地域，，则需要有适宜其生长的法治土壤。在法治国家建设与诚信政府建设的大环境下，信赖保护原则的理论研究日趋成熟，法律体系不断予以完善，其法治价值在行政管理实践中也逐渐呈现。在相对人信赖权益保障、行政权力得以约束与规范、政府诚信建设等方面，都渗透着信赖保护原则的法治精神。但信赖保护原则的法治价值在具体的行政执法实践中并非得到完全充分的显现，体现信赖保护原则的法律体系仍然不完善，相对人信赖利益的保护方式仍然不健全，信赖利益与公共利益的衡量缺乏相应的程序，政务网络化对相对人信赖利益的保护也提出了更高要求。法律的生命与价值均在于实践，只有在行政法域中不断完善信赖保护原则的制度体系，才能让其在行政执法实践中继续凸显其权利保障价值。

The principle of trust protection as a foreign legal system was introduced into China in the time is not long. The academic circles also have different theoretical system for the study, but the principle of development in China is still faster. Of course, a legal system was transplanted to a new domain method requires a region, suitable for the growth of the rule of law in the soil. The construction of rule of law and the integrity of government environment, the theoretical research on the principle of trust protection is becoming more and more mature, continue to perfect its legal system, the value of the rule of law gradually present in administrative management in practice. In the relative administrative power to protect the interests of the trust, constraints and norms, the government credit construction, are permeated with the spirit of the rule of law to protect the principle of trust.
