大数据时代网络群体行为的法治化治理探究

【摘要】：大数据时代,网络群体行为如非法获取、泄露和贩卖公民个人信息、网上诈骗、网络谣言、垃圾信息等的发生层出不穷,这给社会生活造成了恶劣的影响,部分甚至造成社会冲突事件。因此,加强网络群体行为的法治化治理,对于维护社会秩序具有重要意义。本文主要分为三个部分。第一部分主要阐释了网络群体行为的生成机理及其社会影响和差异化治理的大致路径,并指出大数据技术运用对网络群体行为治理所存在的积极和消极双重影响。第二部分主要分析大数据时代网络群体行为治理所面临的诸多法治挑战,包括权力滥用和权利受损等。第三部分试图给大数据时代网络群体行为治理提出一些法治化的治理对策,为此,笔者提出了大数据时代网络群体行为法治化治理的三项原则,即依法合规、公开透明、以数据为核心；并提出在大数据时代,政府对于网络群体行为的治理模式应该是“权利指向”下的服务引导模式。
[Abstract]:In the era of big data, the behavior of network groups such as illegally obtaining, divulging and selling citizens' personal information, online fraud, network rumors, spam information and so on occurred in endlessly, which had a bad impact on social life. Some even cause social conflicts. Therefore, to strengthen the governance of network group behavior, This paper is divided into three parts. The first part mainly explains the formation mechanism of network group behavior and the general path of social influence and differential governance. It also points out the positive and negative effects of big data's technology application on the governance of network group behavior. The second part mainly analyzes the many legal challenges faced by the network group behavior governance in the era of big data. The third part tries to put forward some countermeasures of governance of network group behavior in big data's time. Therefore, the author puts forward three principles of the governance of network group behavior in the era of big data. That is, according to the law, open and transparent, data as the core, and put forward in big data era, the government's governance mode of network group behavior should be "right directed" under the service guidance model.
