论“分享经济”下我国劳动法保护对象的扩张——以互联网专车为视角

【摘要】:近些年,以互联网专车为代表的"分享经济"在全球迅速发展。这一经济模式创造了从属性更加松散的就业模式,就业主体的工作独立性相对较高,也面临一定的就业风险。然而,传统的以劳动关系和劳务关系为界分的劳动法调整路径难以很好地平衡分享经济的发展与就业主体权益保障之间的关系。为此,现行劳动法有必要扩大传统的保护对象范围,在劳动者和劳务提供者之间增设具有经济依赖性的劳务提供者主体,并为其提供适当的类似劳动者的法律保护,从而为分享经济下的劳务提供者提供更为合理的保护路径选择。
[Abstract]:In recent years, the "sharing economy", represented by the Internet private car, has developed rapidly in the world. This economic model has created a more loosely subordinate employment model, and the job independence of the main body of employment is relatively high. However, it is difficult to balance the relationship between the development of the sharing economy and the protection of the rights and interests of the employment subjects. It is necessary for the labor law to expand the scope of the traditional object of protection, to increase the economic dependence of labor providers between workers and labor providers, and to provide them with appropriate legal protection similar to that of workers. In order to provide more reasonable protection path choice for the labor service providers under the sharing economy.
