超越平台责任:网络食品交易规制模式之反思

【摘要】：新修订的《食品安全法》规定了网络食品交易第三方平台对平台内经营活动的审核义务和不履行义务的法律责任。透过监管部门的解释,这些规定被理解为平台应当对平台内经营者信息的真实性承担责任,并需主动、全面地审查监管平台上的食品经营行为。扩张平台义务的正当性可以从强调功能主义的公法理论中得到部分支持,但是,由于并未充分考虑平台自身控制违法行为的动机和实践、平台履行义务的能力和成本、平台错误判断对经营者的影响等因素,当前实践对平台责任的强化超出了适当限度。监管部门应当修正片面强调平台责任的规制模式,转而在提升自身监管能力的基础上,探索与平台合作治理的新型规制模式。
[Abstract]:The newly amended Food Safety Law provides for the obligation of the third party platform of online food trading to audit the activities in the platform and the legal liability for non-compliance. These provisions are understood to mean that the platform should assume responsibility for the authenticity of the operator's information within the platform and be proactive, A comprehensive review of the conduct of food operations on regulatory platforms. The legitimacy of expanding platform obligations can be partially supported by a public law theory that emphasizes functionalism, but, As the motivation and practice of controlling illegal behavior, the ability and cost of the platform to fulfill its obligations, and the influence of the platform's misjudgment on the operator are not fully considered, The current practice of strengthening the platform responsibility beyond the appropriate limit, the regulatory authorities should amend the one-sided emphasis on the platform responsibility of the regulatory model, and on the basis of improving their own regulatory capacity, explore a new regulatory model of cooperation with the platform governance.
