法价值视野下的草原生态环境权

【摘要】：法的价值作为动态发展过程,依人的需求呈现不同价值因素和价值内容,秩序、公平(正义)、平等、效益、自由、人权及和谐等是其涵盖的基本内容。草原生态环境权作为人权的具体表现,面对草原生态环境的严重恶化,将其纳入法治轨道是法价值实现的内在要求和必要结果。草原生态环境权的提出是法价值的必然要求,草原生态环境权的现状是法价值的体现程度,草原生态环境权的保障是法价值的追求。
[Abstract]:The value of law, as a dynamic development process, presents different value factors and contents according to the needs of human beings, order, fairness (justice, equality, benefit, freedom, etc.). Human rights and harmony are its basic contents. The grassland ecological environment right, as a concrete manifestation of human rights, faces the serious deterioration of grassland ecological environment. Bringing it into the track of ruling by law is the inherent requirement and necessary result of realizing the value of law, the putting forward of the right of ecological environment of grassland is the inevitable requirement of the value of law, and the present situation of right of ecological environment of grassland is the embodiment of the value of law. The protection of grassland ecological environmental right is the pursuit of legal value.
