论宗教自由法律保障的中国化道路

【摘要】：宗教自由是一项基本人权,是我国宪法规定的公民基本权利,是现在民主法治国家中公民不可缺少的权利。历史发展的过程中,因为压迫和侵犯宗教自由而付出沉痛代价的事例不再少数,因为不同的信仰而压抑以及迫害引发的宗教冲突、甚至战争也很多,这给社会和人民带来了动荡和灾难。我国是人口众多,多民族多宗教的国家,保护好公民的宗教自由,对民族团结,国家富强至关重要。本文从宗教自由的名称、内涵切入,提出宗教自由权利的逻辑结构,并结合我国的实际情况,对当前我国宪法三十六条所规定的宗教自由进行剖析,对比美国、日本、德国对于宗教自由保护的模式,发现我国宗教自由保护的优势以及存在的不足。重点针对我国宗教自由存在的问题,提出我国宗教自由法律保护的三条路径,以此来完善我国宗教自由保护的法律体系,并希望通过保护好宗教自由这一权利,能够更好地保护公民的其他基本权利。
[Abstract]:Freedom of religion is a basic human right, a basic right of citizens stipulated in our constitution, and an indispensable right of citizens in a democratic country under the rule of law.In the course of historical development, there are no fewer instances where the price of oppression and violation of religious freedom is not limited, and religious conflicts and even wars caused by oppression and persecution due to different beliefs are numerous.This has brought unrest and disaster to society and the people.China is a country with a large population and many nationalities and religions. It is very important to protect the religious freedom of its citizens for the unity of the nation and the prosperity and strength of the country.From the name and connotation of religious freedom, this paper puts forward the logical structure of the right to religious freedom, and combining with the actual situation of our country, analyzes the religious freedom stipulated in Article 36 of the present Constitution of our country, and compares it with the United States and Japan.Germany finds the advantages and disadvantages of the protection of religious freedom in Germany.Focusing on the existing problems of religious freedom in China, this paper puts forward three ways of legal protection of religious freedom in our country, in order to perfect the legal system of religious freedom protection in our country, and hope that the right to protect religious freedom can be well protected.To better protect other fundamental rights of citizens.
