行政许可立法执法若干问题研究

【摘要】：《中华人民共和国行政许可法》(以下简称《行政许可法》)系于2004年7月1日起开始正式实施。《行政许可法》规定了行政许可法定、公开、公平、便民等原则，并规定了听证、信赖利益保护等制度，在中国法治建设过程中具有重要的意义。但《行政许可法》实施以来，在立法本身以及执法过程中也暴露出诸多法律问题。本文拟对《行政许可法》的立法、执法问题进行研究，以对《行政许可法》的完善提出建议。本文从以下几个方面进行研究：第一部分对行政许可的涵义、历史渊源、类型、功能进行论述，首先阐述行政许可的基础理论。第二部分对《行政许可法》的立法背景、原则、意义进行论述，《行政许可法》实施取得了巨大的历史进步，并规定了一系列的法律原则和法律制度，具有重要的历史意义。第三部分对《行政许可法》的立法、执法中存在的若干法律问题进行分析。首先在立法过程中存在诸如行政许可界限模糊，对行政许可的取得、行政许可撤回程序规定不具体，再如听证程序、信赖利益保护原则无法操作等问题。在执法过程中存在执法权滥用、监管不力等问题。第四部分对德、美、英、日四个具有代表意义的国家的行政许可制度进行概括陈述，指出国外行政许可制度的诸多特点，以供借鉴。第五部分论述进一步完善行政许可制度的建议，主要包括明确行政许可的界限，提高行政许可设定的法律层级，，完善信息公开制度，完善听证、信赖保护、补偿等制度。
[Abstract]:The Administrative Licensing Law of the people's Republic of China (hereinafter referred to as the Administrative Licensing Law) was formally implemented on July 1, 2004.The Law on Administrative Licensing stipulates the principles of administrative licensing law, openness, fairness, convenience, and so on, and provides for hearing.The system of the protection of trust interests is of great significance in the process of the construction of rule of law in China.However, since the implementation of the Administrative Licensing Law, many legal problems have been exposed in the legislation itself and in the process of enforcing the law.This paper intends to study the legislation and enforcement of the Administrative Licensing Law in order to put forward some suggestions for the perfection of the Administrative Licensing Law.This article carries on the research from the following several aspects: the first part discusses the meaning, the historical origin, the type, the function of the administrative license, first expounds the basic theory of the administrative license.The second part discusses the legislative background, principles and significance of the Administrative Licensing Law. The implementation of the Administrative Licensing Law has made great historical progress, and has stipulated a series of legal principles and legal system, which has important historical significance.The third part analyzes the legislation and law enforcement of Administrative Licensing Law.There are some problems in the process of law enforcement, such as abuse of law enforcement power, weak supervision and so on.The fourth part summarizes the administrative licensing system of Germany, the United States, Britain and Japan, and points out the characteristics of foreign administrative licensing system for reference.The fifth part discusses the suggestions to further improve the administrative licensing system, mainly including clarifying the limits of administrative licensing, raising the legal level of administrative licensing, perfecting the system of information disclosure, perfecting the system of hearing, trust protection, compensation, and so on.
