【摘要】：2010年我国住房和城乡建设部曾组织起草《住房保障法》，将其纳入立法计划，并计划于2013年公布实施。但是，2012年住房与城乡建设部又发表声明称现阶段制定《住房保障法》存在诸多困难，将先制定行政法规。由此可见，公民住房权作为基本人权在得到国家立法机关重视的情况下，其专门立法保护的实现依然存在诸多理论和制度上的障碍。因此，，梳理公民住房权国内外立法保护的研究现状，对于我国日后《住房保障法》的制定和实施都将大有裨益。公民住房权作为发展权中的社会权，其实现的主要责任主体是国家，实现方式是国家的积极行政行为。而国家积极行政行为的行使，必须有其明确的立法依据。基于此，制定公民住房权的专门立法就成为公民住房权能够实现的法律基础。而对公民住房权国际立法保护进行比较分析将有助于逐步建立符合我国国情的公民住房权立法保护体系。因此，文章将从以下四个方面对公民住房权立法保护进行具体论述：第一部分对公民住房权进行法理分析，法理分析为公民住房权立法保护提供理论依据。通过公民住房权的法律界定、具体权利构成和与相关民法权利的比较，明确公民住房权的社会权属性。第二部分论证公民住房权立法保护的必要性和可行性。必要性在于公民住房权的基本人权属性，基本人权的立法保护是国家所承担的基本国际法义务，也是完善一国法律体系的基本要求；可行性则是通过宪法保护和政府及公民个人的作用来促进公民住房权立法保护的实现。第三部分主要介绍公民住房权立法保护的国际现状，通过对国际组织和其他国家公民住房权立法保护的研究，归纳总结对我国公民住房权立法保护的启示，为我国公民住房权立法保护体系的建立提供实现路径。第四部分系统论述我国公民住房权立法保护的实现路径。公民住房权作为基本人权，实现其立法保护首先须在宪法中明确宣告公民具有积极的住房权，同时规定国家的法定公民住房权保障义务。其次，公民住房权作为社会权，其实现的主要路径是通过公民住房权保护的专门社会立法——《住房保障法》。本文将从具体制度构建方面，对《住房保障法》保护公民住房权的实现进行论述。最后，公民住房权立法保护的实现还需要专门社会立法之外的相关配套立法的补充。
[Abstract]:In 2010, the Ministry of Housing and Urban-Rural Construction organized the drafting of the Housing Security Law, which was incorporated into the legislative plan, and was planned to be published and implemented in 2013.However, in 2012, the Ministry of Housing and Urban-Rural Development issued a statement saying that there are many difficulties in formulating the Housing Security Law at this stage, and that administrative regulations will be enacted first.It can be seen that, as a basic human right, there are still many theoretical and institutional obstacles to the realization of the special legislative protection of citizens' housing rights.Therefore, combing the research status of the legislation protection of citizens' housing right at home and abroad will be of great benefit to the formulation and implementation of the Housing Security Law in the future in our country.As a social right in the right to development, the main responsibility for the realization of the right to housing is the state, and the way of realization is the positive administrative behavior of the state.And the exercise of the state's active administrative act must have its clear legislative basis.Based on this, making special legislation of citizen's housing right becomes the legal foundation that citizen's housing right can be realized.A comparative analysis of the international legal protection of citizens' housing rights will be helpful to gradually establish a legislative protection system for citizens' housing rights in accordance with the national conditions of our country.Therefore, the article will be from the following four aspects of the protection of civil housing rights legislation for specific discussion:The first part is the legal analysis of the citizen's housing right, which provides the theoretical basis for the protection of the citizen's housing right.Through the legal definition of the citizen's right to housing, the constitution of the specific right and the comparison with the relevant civil rights, the social right attribute of the citizen's right to housing is clarified.The second part demonstrates the necessity and feasibility of the legislative protection of citizen's right to housing.The necessity lies in the basic human rights attribute of the citizen's right to housing, and the legislative protection of the basic human rights is the basic international law obligation of the country and the basic requirement of perfecting a country's legal system.The feasibility is to promote the realization of the legislative protection of citizens' housing rights through the constitutional protection and the role of the government and individual citizens.The third part mainly introduces the international situation of citizen's housing right legislation protection, through the research of the international organization and other countries' citizen housing right legislation protection, summarizes the enlightenment to our country citizen housing right legislation protection.To provide the realization path for the establishment of the legislation protection system of the citizen's housing right in our country.The fourth part systematically discusses the realization path of the legislation protection of the citizen's housing right in our country.As the basic human rights, the realization of the legislative protection of citizens' housing rights must firstly declare clearly in the Constitution that citizens have positive housing rights, and at the same time stipulate the legal obligations of the state's citizens to secure their housing rights.Secondly, as a social right, the main way to realize it is to pass the special social legislation of protecting the citizen's housing right-the Housing Security Law.This paper discusses the realization of protecting citizen's housing right from the aspect of concrete system construction.Finally, the realization of the legislation protection of citizen's housing right needs the supplement of relevant supporting legislation besides the special social legislation.
