劳动者工作环境权研究

【摘要】:工作环境权是一种新型权利,是在职业安全卫生权基础上发展起来的权利。它丰富了职业安全卫生权的内容,使劳动者的权益得到全面的保护。近些年来,很多发达国家和一些国际组织十分关注工作环境权。他们逐渐认识到工作环境权的重要性,改变旧的立法形式并突出劳动者的主体地位,在职业安全卫生权的基础上确立了工作环境权。我国也十分重视对劳动者工作环境权相关权益的保护,但针对工作环境权的研究并不深入。目前,与工作环境权相关的劳动者职业安全卫生问题在我国的形势仍不容乐观,职业安全卫生问题在立法方面仍有不足,急需改善,对劳动者职业安全卫生相关权利缺乏保障,我国应学习国外长处,结合本国国情,对工作环境权予以确立。全文整体上对工作环境权分为四个部分展开研究。第一部分包含工作环境权内涵与性质介绍。本文通过借鉴学者们对工作环境权的不同定义,总结出工作环境权的概念,即该权利是劳动者在工作时获得对其生命安全、身心健康和人格尊严全面保护的权利,其最终目的是实现劳动者的体面劳动。工作环境权所包含的内容也十分广泛,其还具有自由权和社会权双重属性。第二部分从美国、瑞典、英国和日本四个发达国家的工作环境权保护制度的相关内容展开介绍,并对各国的制度加以比较分析,从而总结出值得我国借鉴的内容。第三部分是分析我国确立工作环境权的正当性,从确立工作环境权的必要性和可行性两方面内容展开。立法不足和安全事故频发告诉我们建立工作环境权的必要之处,加之我国有建立工作环境权的相关法律基础和外国经验可以借鉴,为确立工作环境权提供可行性。第四部分总结我国确立工作环境权的具体措施,首先要明确立法理念,体现以劳动者为本位的立法指导思想;其次,要制定统一的工作环境权法,完善工作环境权相关制度;最后在监管上还应建立统一的机构来确保各项措施的具体实施。
[Abstract]:The right to work environment is a new type of right, which is developed on the basis of the right of occupational safety and health.It enriches the content of occupational safety and health rights and makes workers' rights and interests fully protected.In recent years, many developed countries and some international organizations are very concerned about the right to work environment.They gradually realized the importance of the right to work environment, changed the old legislative form and highlighted the principal position of the laborer, and established the right to work environment on the basis of the right of occupational safety and health.China also attaches great importance to the protection of workers' working environment rights and interests, but the research on working environment rights is not deep.At present, the situation of laborer's occupational safety and health related to the right to work environment is still not optimistic in our country, the problem of occupational safety and health is still insufficient in legislation, it is in urgent need of improvement, and it lacks the guarantee of workers' rights related to occupational safety and health.China should learn from foreign strengths and establish the right to work environment.The whole thesis is divided into four parts.The first part contains the connotation and nature of the right to work environment.By referring to the different definitions of the right to work environment, this paper sums up the concept of the right to work environment, that is, the right is the right of workers to obtain the full protection of their life safety, physical and mental health and human dignity in their work.Its ultimate goal is to realize the decent work of the laborer.The right to work environment contains a wide range of contents, and it also has the dual attributes of freedom and social rights.The second part introduces the relevant contents of the working environment right protection system in the four developed countries of the United States, Sweden, Britain and Japan, and makes a comparative analysis of the systems of various countries, thus summing up the contents that our country can use for reference.The third part is to analyze the legitimacy of establishing the right to work environment, from the necessity and feasibility of establishing the right to work environment.The insufficiency of legislation and frequent occurrence of safety accidents tell us the necessity of establishing the right to work environment, in addition, our country has the relevant legal basis and foreign experience to establish the right of working environment, which provides the feasibility for establishing the right of working environment.The fourth part summarizes the concrete measures to establish the right to work environment in our country. Firstly, we should make clear the legislative idea and embody the guiding ideology of legislation based on laborer; secondly, we should formulate a unified law on the right to work environment and perfect the relevant system of the right to work environment.Finally, a unified regulatory body should be established to ensure the implementation of the measures.
