中国海警海上执法存在的问题及其对策研究

【摘要】：2013年3月14日，第十二届全国人大第一次会议审议通过《国务院机构改革和职能转变方案》，重新组建国家海洋局。国家海洋局以中国海警局（CHINA COAST GUARD）名义开展海上维权执法。但由于我国海洋法律法规本身的不健全不完善，以及本次改革采取的是机构先行等原因，致使新组建的中国海警局无论是在执法依据上，还是在执法过程中都存在一些亟待解决的问题。这些问题的存在，严重制约了中国海警海上执法工作的顺利开展，也很难有效维护国家海洋权益和海上安全。由于中国海警局为新设机构，在本文之前，许多专家学者主要是对海上执法体制进行研究，，涉及中国海警局海上执法的内容相对较少。在结构安排上，本文由四个部分构成。第一章主要介绍中国海警的发展和构成，海上执法的特点和原则。第二章深入分析了我国海洋法律体系建设，也就是海警海上执法依据方面存在的问题和缺陷。第三章深入分析了中国海警海上执法本身存在的弊端，以及影响中国海警海上执法的突出问题。第四章是本文的落脚点，在前文分析的基础上，对中国海警海上执法提出了相应的对策和建议。
[Abstract]:On March 14, 2013, the first session of the Twelfth National people's Congress deliberated on the adoption of the State Council's Program for Institutional Reform and functional Transformation to re-establish the State Oceanic Administration.The State Oceanic Administration carries out maritime rights enforcement on behalf of China Sea Police Department (CHINA COAST GUARD).However, due to the imperfections of China's maritime laws and regulations itself and the fact that the reform is based on institutional priorities, the newly established China Sea Police Department, whether on the basis of law enforcement,There are still some problems to be solved in the course of law enforcement.The existence of these problems has seriously restricted the smooth development of the maritime law enforcement work of China's marine police, and it is also very difficult to effectively safeguard the national maritime rights and interests and maritime safety.Since China Sea Police Station is a new institution, before this paper, many experts and scholars mainly study the maritime law enforcement system, and the content of maritime law enforcement involving China Sea Police Station is relatively small.In the structure arrangement, this article is composed of four parts.The first chapter mainly introduces the development and composition of China's marine police, the characteristics and principles of maritime law enforcement.The second chapter deeply analyzes the problems and defects of maritime law enforcement in our country.The third chapter deeply analyzes the disadvantages of the maritime law enforcement and the prominent problems that affect the maritime law enforcement.The fourth chapter is the foothold of this paper, on the basis of the previous analysis, put forward the corresponding countermeasures and suggestions to the maritime law enforcement of Chinese coast police.
