深化宁波市综合行政执法体制改革研究

【摘要】：二十年来,我国的行政体制发现了重大变化,体制改革取得明显成效,而对综合行政执法体制的探索就是其中的一个亮点和改革的重点之一。正在进行中的宁波市综合行政执法体制改革虽已取得一定成效,但存在各种困难,进展并不如人意。本文通过梳理综合行政执法体制改革的内涵及影响其发展的制约因素,从执法法规体系、管理体系、工作体系、公众参与、科技创新、能力提升、救济解决、保障体系等角度提出切实可行的改革路径,从而为推进宁波市综合行政执法体制改革提出建议意见。本文第一部分即绪论,主要阐述深化宁波市综合行政执法体制改革的研究背景及在学术研究和执法实务上的重要意义,分析国内外研究现状,并提出论文的研究思路与研究方法。第二部分首先从理论上来探讨综合行政执法体制改革,主要分析了综合行政执法体制改革的内涵与特征,研究综合行政执法在执法机构、执法方式、执法后果等方面与城市管理执法等相近执法体制机制的联系与区别,并指出综合行政执法体制改革的理论基础包括政府治理理论、整体性治理理论和街头官僚理论等。其次,总结综合行政执法的国内外实践,从德国的秩序局和我国的青岛市等获得借鉴。第三部分是从历时角度研究宁波市综合行政执法体制改革的历程与现状。宁波市综合行政执法体制改革的历程分为相对集中行政处罚权与宁波市综合行政执法体制改革的起步(2002年至2009年)和改革试点的深化与宁波市综合行政执法体制改革的发展(2010年至2015年)两个阶段,2016年开始,宁波市综合行政执法体制改革全面推进,建立了改革的组织架构、完善制度机制、成立综合行政执法机构等。第四部分是研究宁波市综合行政执法体制改革的成效,目前宁波市从综合执法体制上看已经初具雏形,建立了综合行政执法体制改革组织体系,明确了综合行政执法范围,法规政策体系不断完善,综合行政执法管理体制形成;从综合执法能力上看正不断提升,调整整合了相关执法机构设置,人员编制配备得到了优化,建立了网络行政执法平台;从改革的保障上看更加有力,工作责任已经明确,各相关单位的职责边界界定清楚;从实际效果上看改革取得一定成效,行政执法办案的质量和数量都在提升,社会反响也比较好。第五部分是探讨深化宁波市综合行政执法体制改革面临的问题,这些问题表现在行政执法管理架构上包括行政体制与改革导向间还存在冲突,组织体系运行还不够顺畅,协调机制不够完善;表现在制度规范上,包括改革需要修订的法律法规很多,执法主体的权威性不足,职能划转不科学等;表现在执法力量上,基层执法队伍规模偏小,执法人员能力偏弱;表现在面临的外部困难上,包括工作量成倍增加、群众不理解和暴力抗法、执法保障不足等。第六部分是提出深化宁波市综合行政执法体制改革的路径,在健全综合行政执法管理体制方面,要完善综合行政执法组织体系,健全网格化机制,完善协作配合机制,建立协调指挥机制和考核督查机制等;在完善综合行政执法工作制度方面,要健全综合行政执法内部工作制度,鼓励公众积极参与,建立多方共同监督制度等;在强化综合行政执法体制改革的各类保障方面,要制订完善与综合行政执法体制相关的各类法律法规,、建设高素质的执法队伍、保障综合行政执法工作所需的财物,并提供有力的科技保障和公安保障等。
