保障人权视阈下的身份证查验研究

【摘要】：身份证查验是公安机关的法定职责,贯穿于公安机关的行政执法与刑事执法过程之中。回溯身份证查验的立法沿革,从打击犯罪到保障人权的价值转变,梳理有关身份证查验的若干争论,正确认识身份证查验的必要性、规范性、有责性。以身份证查验引起的社会热点事件为例,提出以正当程序为引领、以两法衔接为中心、以科技手段为突破,完善公安机关身份证查验机制。
[Abstract]:Identity card examination is the legal duty of public security organs, which runs through the process of administrative law enforcement and criminal law enforcement of public security organs.Looking back on the legislative evolution of ID card examination, this paper changes the value from combating crime to protecting human rights, combs some arguments about ID card examination, and correctly recognizes the necessity, standardization and responsibility of ID card examination.Taking the social hot events caused by ID card examination as an example, this paper puts forward that the identification system of public security organs should be perfected by taking due process as the guide, the two laws linking up as the center, and the scientific and technological means as the breakthrough.
