论职业足球联盟的法律规制

【摘要】：在社会主义市场经济体制改革不断深化与要求社会管理体制创新的大好趋势下，完善我国职业足球联盟管理机制的机遇已经到来，职业足球联盟的建立是解决当前我国足球产业职业化所产生的一系列问题最为直接和有效的措施与手段。通过对职业足球联盟这种职业体育运作模式的分析，从管理模式、产权框架、联盟权能等方面研究职业联盟相关法律规制问题，并与欧洲足球强国举办联赛成功模式相结合，，推出要向实现竞技足球职业化建立职业足球联盟的应然性与重要性，并从理论角度找出其内在的运行机制与外部运营准则的联系，总结在这内外两层面上法律规范所起到的作用，论证职业足球联盟产生的必要性与现实意义。再通过与我国职业足球联盟的现状及法律适用对比，得出我国职业足球联赛管理体制的缺陷与不足。从而指明我们建立这样职业足球联盟的改革思路和框架构想，并从建立纠纷解决机制、管理制度的改革等方面来完善中国职业足球联盟的法律规制，对我国职业足球联盟的发展提出建议和对策。以期从法治角度为中国足球联赛职业化深化改革指出一条可行性道路。
[Abstract]:Under the great trend of deepening the reform of the socialist market economy system and demanding the innovation of the social management system, the opportunity to perfect the management mechanism of our professional football league has come.The establishment of professional football league is the most direct and effective measure to solve a series of problems arising from the professionalization of football industry in our country.Based on the analysis of the professional sports operation mode of professional football league, this paper studies the legal regulation of professional league from the aspects of management mode, property rights framework, league power and so on, and combines with the successful mode of European football powerful country to hold league matches.It is necessary and important to establish the professional football league to realize the professionalization of competitive football, and to find out the relationship between the internal operating mechanism and the external operation criterion from the theoretical point of view.In this paper, the author summarizes the role of legal norms on both internal and external levels, and demonstrates the necessity and practical significance of professional football league.Through the comparison with the present situation and the law application of the professional football league in our country, the defects and shortcomings of the management system of the professional football league in our country are obtained.This paper points out the reform ideas and frame ideas of establishing such professional football league, and consummates the legal regulation of China professional football league from the aspects of establishing dispute resolution mechanism and reform of management system, etc.Suggestions and countermeasures are put forward for the development of professional football league in China.From the point of view of rule of law, this paper points out a feasible way to deepen the reform of the professionalization of China Football League.
