中国地方图书馆立法保障读者权利问题研究

【摘要】：读者权利是一项早已被国际社会所认同的基本人权，世界上许多国家已经对读者权利予以了立法保护。近年来，读者权利的保障问题在我国也受到越来越高的关注和重视。读者权利的保障水平与图书馆法制建设的完善程度休戚相关。随着公民权利意识的逐渐觉醒，维权意识的不断增强，要求以法律手段保障读者权利的呼声日益高涨。在我国尚无由全国人大制定的国家层面《图书馆法》的法制背景下，地方图书馆立法的制定和实施，无疑是对我国图书馆事业法治化进程的有效充实，也是对读者权利维护的有力保障。笔者在研究和总结国内已有相关成果的理论背景下，以我国地方图书馆立法为研究对象，以读者权利保障问题为研究核心，，开展理论研究。本文在介绍了我国地方图书馆立法现状的基础上，对我国已有的14部地方图书馆立法在内容上从多方面进行了异同分析。以我国法律对读者权利的规定为法理依据，以代表性学者对“读者权利”的定义为参考，诠释了笔者对读者权利内涵的理解。通过缕析各地方图书馆立法中有关读者权利的规定，对比分析了各立法在保障读者权利方面的进步性和不足之处。文章根据指出的问题，给出了比较有针对性的建议，以期完善我国已有的图书馆立法，并为以后制定更为科学、合理的图书馆立法提够理论支撑，以此达到促进图书馆事业发展和更好维护读者权利的目的。
[Abstract]:Readers' rights is a basic human rights has been recognized by the international community, many countries in the world have been given to the readers' rights protection legislation. In recent years, the problem of protecting readers' rights has also been more and more concern and attention in our country. The level of protection and the legal construction of Library Readers' rights perfect degree bound together in a common cause with the awakening of the consciousness of civil rights, the growing awareness of rights, to legal means to protect the rights of readers is growing. In the background of the legal system law of our country there is no national level library "formulated by the National People's Congress under the formulation and implementation of local legislation of library, is the library cause in China by law the process of effective enrichment, but also a powerful guarantee to the readers' rights maintenance. The author summarizes the theoretical background of domestic existing related research results in the study and, to the local library in China The legislation as the research object, focusing on the protection of the rights of readers to carry out theoretical research. In this paper, introduces the current situation of local legislation for libraries in China, the existing 14 local library legislation in the content from the aspects of the similarities and differences. In China's legal provisions for the legal rights of readers according to the representative scholars of "readers right" is defined as a reference, the interpretation of the authors understanding of the connotation of the readers' rights. Through the provisions of the relevant rights of readers analyze local library legislation, comparative analysis of the legislation on the protection of readers' rights progress and deficiencies. The article pointed out that according to the problems presented the comparison of targeted recommendations, in order to improve our existing library legislation, and to develop a more scientific and reasonable, the library legislation provides enough theoretical support to promote the book The purpose of the development of the librarianship and the better maintenance of the reader's rights.
