【摘要】：过失相抵规则，它是侵权行为法中的一项特殊制度，在现实法律实务中具有重要意义。我们的法律虽然已经确定了过失相抵的适用，但其规定不全面，导致过失相抵规则不会在实际应用中，发挥它的重要价值。因此，在研究过失相抵的基本理论的基础上，首先介绍过失相抵的概念以及法律特征，并且借鉴理论界关于适用过失相抵的四种学说。其次过失相抵规则在我们国家的多部法律中，都有所体现，虽然规定的并不全面，但是通过分析条文的含义，明确得出我国认可过失相抵在无过错责任归责原则下的适用。关于过失相抵的适用条件与范围，各个国家有着不同的做法，通过对不同的学说的分析，总结出过失相抵在我国道路交通事故损害赔偿中所应具备的条件以及适用范围，为过失相抵在司法实务中的运用提供了法理依据。再次，，通过对我们的法律实践中的应用情况分析，总结了我国交通事故损害赔偿案件中运用过失相抵时存在的问题。最后，本文在在借鉴外国相法律与实务经验的基础上，结合我国审判实务中存在的问题，提出过失相抵在司法实践中的适用建议，从而在审判实务中更好地运用这个规则，发挥出过失相抵的重要价值。
[Abstract]:Fault offset rule, which is a special system in tort law, is of great significance in practice.Although our law has confirmed the application of fault offset, its provisions are not comprehensive, leading to the fault offset rule will not play its important value in practical application.Therefore, on the basis of studying the basic theory of fault offset, this paper first introduces the concept of fault offset and its legal characteristics, and draws lessons from the four theories on the application of fault offset in the theoretical circle.Secondly, the rule of fault offset is embodied in many laws of our country. Although the stipulation is not comprehensive, it is clear that the principle of fault offset is applicable under the principle of no-fault liability.As to the applicable conditions and scope of fault offset, different countries have different methods. Through the analysis of different theories, this paper summarizes the conditions and application scope of fault offset in the compensation for road traffic accident damage in our country.It provides a legal basis for the application of fault offset in judicial practice.Thirdly, through the analysis of the application of our legal practice, this paper summarizes the problems existing in the application of fault offset in the traffic accident damage compensation cases in our country.Finally, on the basis of drawing lessons from foreign countries' experience of law and practice, combined with the problems existing in our country's trial practice, this paper puts forward some suggestions for the application of fault offset in judicial practice, so as to make better use of this rule in judicial practice.Give play to the important value of fault offset.
