医师说明义务的伦理学研究——由一起医疗纠纷案例引发的思考

【摘要】：患者知情同意权的实现依赖于医师对疾病状况、医疗措施及风险的说明,医师依法履行说明义务有利于与患者就疾病诊治进行有效沟通,从而预防、减少医疗纠纷,同时医师也就说明的内容构成对其自身的约束。通过一起医疗纠纷案例,侧重探讨医师说明义务的履行与医疗风险的分担,以及医师全面适当履行说明义务的伦理要求。
[Abstract]:The realization of patients' right of informed consent depends on the doctors' explanation of the disease status, medical measures and risks. It is beneficial for doctors to communicate effectively with the patients on the diagnosis and treatment of the disease, thus to prevent and reduce the medical disputes.At the same time, the physician also explains the content of the composition of their own constraints.Through a case of medical dispute, this paper focuses on the fulfillment of doctors' duty of explanation and the sharing of medical risks, as well as the ethical requirements of doctors' full and proper performance of the obligation of explanation.
