中山市综合行政执法改革现状及对策研究

【摘要】：中山市是在全国部分试点城市逐步推广探索综合行政执法改革取得成效之后,以推动政府机构优化重组为基础,深化政府行政职能及行政体制转变为手段,建立适应中山市经济社会发展和市场经济体制要求的职能有机统一的综合行政执法体制。中山市综合行政执法改革是当前建设法治政府、推进依法治国、建设服务型政府的一项重要举措。本文以中山市推进综合行政执法体制改革为研究对象,通过对综合行政执法体制改革相关理论进行分析,分析中山市综合行政执法体制改革的背景、历程和现状,研究分析中山市推进综合行政执法体制改革存在的主要问题及存在问题的主要原因,针对原因,提出进一步深化综合行政执法体制改革的主要对策,着重从构建完善的法律体系、政府职能作用的发挥、监督保障机制的设置、行政执法机构和外部环境的优化、综合行政执法队伍的建设等方面,提出建立起适应中山市经济社会发展的综合行政执法体系的对策建议。通过研究,我们发现,2011年以来,中山市推进新一轮综合行政执法体制改革,探索新的行政体制改革发展之路,在改革领域、拓展功能和执法权限上做出进一步的优化和提升,整合更多的部门和权限,改革更为彻底,目的和实质就是要深化行政执法体制改革,理顺行政执法体制机制,使行政执法管理体制更加适应经济社会发展的要求。中山市综合行政执法体制改革,在解决多头执法、重复执法、责任不明等问题上有了新的突破,对于稳定经济社会发展市场秩序、推动经济增长方式转变提供了保障,奠定了基础。通过研究,我们认为,从中山市推进综合行政执法体制改革的路径和成效来看,取得了一定的成绩,但与改革的目标和要求仍然相距甚远,存在的问题是多方面的,既有综合行政执法体制相关法律法规不够完善的原因,也有行政政策难以推进落实的原因,也有外部环境条件制约的原因。尤其是2011年,中山市在推进新一轮综合行政执法改革之初,遇到的阻力和压力较大,不仅要协调市级层面的行政执法功能权限,还要与镇一级相互配套衔接,在整合一部分市镇两级层面的行政执法权限之后,有些综合行政执法部门缺乏有效的组织指挥,结构和体制五花八门,行政执法也是各行其是,在当前的综合行政执法改革体制下,工作成效难有提升。对中山市现行的综合行政执法改革存在的问题进行深入的剖析研究,并提出进一步的深化措施和对策,对推动中山市综合行政执法体制改革,乃至为全国综合行政执法工作开展提供有效的借鉴和示范。
[Abstract]:Zhongshan City, after gradually promoting and exploring the achievements of comprehensive administrative law enforcement reform in some pilot cities throughout the country, is based on promoting the optimization and reorganization of government institutions and deepening the transformation of government administrative functions and administrative systems as a means. To establish a comprehensive administrative law enforcement system which can meet the needs of economic and social development and market economy in Zhongshan City. The reform of comprehensive administrative law enforcement in Zhongshan City is an important measure to build a government ruled by law, to promote the rule of law and to build a service-oriented government. This paper takes Zhongshan City to promote the reform of the comprehensive administrative law enforcement system as the research object, through the analysis of the relevant theories of the comprehensive administrative law enforcement system reform, analyzes the background, the course and the present situation of the comprehensive administrative law enforcement system reform in Zhongshan City. This paper analyzes the main problems and causes of the reform of comprehensive administrative law enforcement system in Zhongshan City, and puts forward the main countermeasures for further deepening the reform of comprehensive administrative law enforcement system in Zhongshan City. Focusing on the construction of a sound legal system, the role of government functions, the establishment of supervisory and security mechanisms, the optimization of administrative law enforcement agencies and the external environment, the construction of comprehensive administrative law enforcement teams, etc. The countermeasures and suggestions of establishing a comprehensive administrative law enforcement system adapted to the economic and social development of Zhongshan City are put forward. Through our research, we find that since 2011, Zhongshan City has promoted a new round of comprehensive administrative law enforcement system reform, explored the road of development of new administrative system reform, and made further optimization and upgrading in the field of reform, expanding functions and law enforcement authority. The purpose and essence of the reform is to deepen the reform of the administrative law enforcement system, straighten out the administrative law enforcement system mechanism, and make the administrative law enforcement management system more suitable for the economic and social development. The reform of the comprehensive administrative law enforcement system in Zhongshan City has made new breakthroughs in solving the problems of multi-head law enforcement, repeated law enforcement, unclear responsibility, etc., which has provided a guarantee for stabilizing the market order of economic and social development and promoting the transformation of economic growth mode. Laid the foundation. Through the research, we believe that from the path and effect of the comprehensive administrative law enforcement system reform in Zhongshan City, some achievements have been made, but it is still far from the objectives and requirements of the reform, and the existing problems are various. There are some reasons for the imperfection of relevant laws and regulations in the comprehensive administrative law enforcement system, the reasons for the difficulty of implementing the administrative policies, and the reasons for the external environmental constraints. Especially in 2011, at the beginning of promoting a new round of comprehensive administrative law enforcement reform, Zhongshan City encountered great resistance and pressure. It is necessary not only to coordinate the functional limits of administrative law enforcement at the municipal level, but also to link up with each other at the town level. After integrating the administrative law enforcement powers at the municipal and municipal levels, some comprehensive administrative law enforcement departments lack effective organization and command, with a wide variety of structures and systems, and administrative law enforcement is carried out on its own. In the current comprehensive administrative law enforcement reform system, the effectiveness of the work is difficult to improve. The problems existing in the current comprehensive administrative law enforcement reform in Zhongshan City are deeply analyzed and studied, and further deepening measures and countermeasures are put forward to promote the reform of the comprehensive administrative law enforcement system in Zhongshan City. Even for the national comprehensive administrative law enforcement work to provide effective reference and demonstration.
