网络立法中的用户法律保护探析

【摘要】：中国正加快互联网领域立法工作,全面推进网络空间法治化,在此进程中通过网络立法保护网络用户权利显得非常必要。论述了立法保护网络用户权利的重要意义:一是具体落实公民的言论自由宪法权利;二是将新媒介对网民的技术赋权提升到法律层面;三是推动公民依法形势舆论监督的宪法权利。还阐释了权利保护与对自由的限制在相当程度上具有共通性,且我国已有相关立法加以规制,对网络用户权利的充分保护不致侵害他人合法权益,也不会冲击正常的社会秩序和社会公正。
[Abstract]:China is speeding up legislation in the field of the Internet and comprehensively promoting the rule of law in cyberspace. In this process, it is very necessary to protect the rights of network users through network legislation. This paper discusses the significance of legislation to protect the rights of Internet users: first, to implement citizens' constitutional right to freedom of speech; second, to promote the technical empowerment of Internet users by the new media to the legal level. Third, promote citizens' constitutional right to supervision by public opinion in accordance with the law. It also explains that the protection of rights and the restriction of freedom are common to a certain extent, and our country already has the relevant legislation to regulate, the full protection of the rights of network users will not infringe upon the legitimate rights and interests of others. Nor will it impinge on normal social order and social justice.
