网络规则的建构与软法治理

【摘要】：现有网络立法的不足、政府治网职责的缺失以及网络规范的漏洞,导致网络社会治理捉襟见肘,亟待建立正当化、规范化和系统化的网络规则体系。网络空间治理规则是政府回应、组织赋权、开放协调和实践创新的产物,是网络软法治理的核心组成部分。通过规则的软法治理,有利于维护主权国家的网络安全、消解网络治理的不稳定因素,进而逐步实现国家网络治理能力的提升。构建网络规则的治理体系离不开有效的制度设计,应当厘清网络主体职责、规范网络规则审查程序、倡导网络规则的标准化建设、增强网络空间规则的柔性治理,进而探索"互联网+法律"时代网络空间治理的多元主体合作模式以及软硬兼施、协同共治的网络秩序治理机制。
[Abstract]:The deficiency of the existing network legislation, the lack of the responsibility of the government to govern the network and the loophole of the network standard lead to the lack of the network social governance. It is urgent to establish a legitimate, standardized and systematic network rule system. The rule of cyberspace governance is the product of government response, organizational empowerment, open coordination and practical innovation, and is the core component of network soft law governance. The soft law governance of rules is conducive to maintaining the network security of sovereign countries, dispelling the unstable factors of network governance, and gradually realizing the enhancement of national network governance ability. The construction of the governance system of the network rules can not be separated from the effective system design. We should clarify the responsibilities of the network subjects, standardize the examination procedures of the network rules, advocate the standardization construction of the network rules, and strengthen the flexible governance of the cyberspace rules. Then it explores the cooperation mode of multiple subjects in cyberspace governance in the era of "Internet law" and the network order governance mechanism which can be applied both hard and soft and cooperate with each other.
