城市市容环境卫生管理立法完善研究

【摘要】：城市市容环境卫生与市民生活息息相关,它是一个城市发展状况、管理水平、文明程度、市民素质的直观反映。良好的人居环境,是城市居民对城市的向往。城市市容环境卫生管理是打造良好城市环境的保障和城市发展的永恒主题。由于目前我国城市市容环境卫生管理法规建设滞后,法律体系不够健全,规定内容疏漏颇多,且过于笼统,缺乏可操作的配套法规指导和支持,对职能部门权责规定不明确,我国城市市容环卫管理状况并不乐观。基于上述考虑,文章立足于我国城市市容环卫管理立法现状和实际管理中遇到的问题,结合国外相关领域成功的立法实践,探讨如何完善我国城市市容环境卫生管理立法,目的在于通过立法的完善,使我国城市市容环境卫生管理各项工作在法制轨道上良性运行,从而为市民创造良好的人居环境。建立完备的法规体系,保证各项规定的详细可操作是做好城市市容环境卫生管理工作的前提。依法管理是城市市容环卫管理的必由之路,要实现有效的城市市容环卫管理,必须从中央到地方建立健全城市市容环卫管理完备的法律体系,以从根本上解决法规滞后制约城市市容环卫管理的问题。要深入研究城市市容环卫管理现有相关法律法规,通过下基层调研,结合城市市容环卫管理工作实际,制定城市市容环卫管理具有实际可操作性的法律法规和条例,并在实践中不断修改和完善。严格的执法是城市市容环境卫生管理规范有序的有力保障。市容环境管理的目的是要为身处城市中的每一个人创造一个良好的市容环境卫生空间,为了保障全体市民的这项权利,必须通过立法明确市民个体在城市市容环境卫生当中的义务,并制定相应的监管和处罚措施,以不近人情的严格执法,保证城市市容环境卫生管理各项工作规范进行。提高民众的环卫意识,让市民真正参与到城市市容环境卫生管理中来,是做好城市市容环境卫生工作的根本途径。让每一位市民参与到市容环境卫生管理当中,让其既是受益者又是参与者,才能有效提高市民的爱护环境卫生意识。多国实践证明,树立民众的环卫意识,发动市民参与到市容环境卫生治理中,比任何惩罚约束方式都行之有效,这是保证市容环境卫生管理效果的根本。完善的机制体制是市容环境卫生工作顺利开展的关键。管理主体明确,结构合理,监管考核到位,才能确保权责明晰,协调配合顺畅,使各方面工作有条不紊推进,最终实现市容环境卫生良性发展。
[Abstract]:The city appearance environment sanitation is closely related to the citizen life, it is a city development condition, the management level, the civilization degree, the citizen quality visual reflection. Good living environment is the yearning of city residents. The environmental sanitation management of city appearance is the eternal theme of creating a good urban environment and urban development. At present, the construction of the laws and regulations on urban appearance and environmental hygiene management in our country is lagging behind, the legal system is not perfect enough, the provisions are many omissions, they are too general, they lack the guidance and support of operational supporting laws and regulations, and the provisions on the powers and responsibilities of the functional departments are not clear. Our country city appearance sanitation management condition is not optimistic. Based on the above considerations, based on the current situation of urban sanitation management legislation in China and the problems encountered in the actual management, combined with the successful legislative practice in foreign related fields, this paper discusses how to improve the legislation on urban appearance and sanitation management in China. The purpose of this paper is to make the environmental sanitation management of city appearance in our country run well on the track of legal system through the perfection of legislation, so as to create a good living environment for the citizens. The establishment of a complete legal system to ensure the detailed operation of the regulations is a prerequisite for the management of city appearance and environmental hygiene. Legal management is the only way to manage city appearance and sanitation. In order to realize the effective management of city appearance and sanitation, it is necessary to establish and perfect a complete legal system for the management of city appearance and sanitation from the central to the local level. In order to fundamentally solve the problem that the laws and regulations lags behind the city appearance and sanitation management. It is necessary to deeply study the existing laws and regulations related to the management of city appearance and sanitation, and to formulate laws, regulations and rules for the management of city appearance and sanitation that are practical and operable through the investigation at the grass-roots level and the actual situation of the management of the city's appearance and sanitation. And in practice constantly modified and improved. The strict law enforcement is the city appearance environment sanitation management standard orderly has the strength safeguard. The purpose of the city's environmental management is to create a good environment and sanitation space for everyone in the city. In order to protect this right of all citizens, It is necessary to make clear through legislation the obligations of individual citizens in urban appearance and environmental hygiene, and to formulate corresponding supervision and punishment measures, to enforce the law strictly in an unnatural manner, and to ensure that the work of urban appearance environmental sanitation management is carried out according to the standards. It is the basic way to improve the sanitation consciousness of the public and let the citizens participate in the management of urban appearance and environmental hygiene. Only by allowing every citizen to participate in the environmental hygiene management of the city, which is both the beneficiary and the participant, can the public's awareness of environmental hygiene be effectively enhanced. The practice of many countries has proved that it is more effective to set up the public's environmental sanitation consciousness and mobilize the citizens to participate in the management of city appearance environmental hygiene than any punishment and restraint method which is the fundamental to ensure the effect of city appearance environmental hygiene management. The perfect mechanism system is the key to the smooth development of the city appearance and environmental sanitation work. Only when the main body of management is clear, the structure is reasonable and the supervision and assessment is in place, can the power and responsibility be clear, the coordination and cooperation be smooth, the work of all aspects can be promoted methodically, and finally the healthy development of the city appearance and sanitation can be realized.
