政府数据开放的法治思维

【摘要】：政府数据开放是指政府不设定任何限制地对自己采集、整理和存储的数据向社会免费公开,以供企业、社会组织和公众查询、复制和使用。政府开放的数据是一种公共资源,须是政府掌控的、非经加工处理的所有原始数据。政府数据开放具有解除封锁、禁令和限制的公开属性;具有实现民主监督权、知情权和数据财产权的权利属性;政府对数据开放拥有管理、控制和服务的公权力属性;具有对政府行为的监督约束、数据标准格式统一、数据开放依照法律政策等的规范性。政府数据开放必须依法而治,从契约思维和诚信思维出发循法而为。
[Abstract]:The opening of government data means that the data collected, collated and stored by the government without any restrictions are made freely available to the society for inquiry, reproduction and use by enterprises, social organizations and the public. Open government data is a public resource and must be government-controlled, non-processed raw data. The opening of government data has the public attribute of lifting the blockade, prohibition and restriction, the right to realize democratic supervision, the right to know and the right to data property, and the government has the public power attribute of management, control and service to data openness. It has the supervision and restriction to the government behavior, the uniform data standard format, the data opening according to the legal policy and so on. The opening of government data must be governed by law.
