【摘要】：随着医疗技术日新月异,涉及的问题也日益复杂和棘手,由此带来的医疗事故倒逼着医疗过失研究的不断深入。根据杨立新教授的理论,医疗过失责任可以细化为三部分:医疗产品过失责任、医疗伦理过失责任和医疗技术过失责任。其中医疗技术过失责任是发生频率最高的,故本文从医疗技术过失的界定为切入点,综合国内外的成功立法研究分析医疗技术过失责任中的注意义务、判断标准及后期司法鉴定等问题,建立合理科学的医疗技术过失司法鉴定体系,以期能最大化的平衡现阶段紧张的医患关系,形成更为和谐的医患关系。本文由以下五个部分构成:第一部分是导论,从医疗过失的特殊性来提出问题,接下来以杨立新教授的观点引出医疗技术过失的研究意义,为第二部分的论述做好铺垫。第二部分是医疗技术过失的理论概述,主要研究了医疗技术过失的基本问题,主要分析医疗技术过失的法律概念、特征、适用范围和责任承担路径。第三部分是医疗技术过失的注意义务,从大陆法系的注意义务理论引出我国医疗技术领域内注意义务的完善,论证医疗技术过失的注意义务与医疗技术过失判断标准之间的逻辑关系。第四部分是医疗技术过失的判断标准,该标准主要依靠建立临床医疗路径来完善,标准要着重考虑了职称和医院级别区分医务人员的认识能力和技术水平,同时期待性原则、紧急性原则、差异性原则等原则作为辅助性标准,通过实例分析证明医疗技术过失的判断标准需要考虑多个因素。第五部分是医疗技术过失的司法鉴定制度优化,通过比较分析国外的医疗技术过失鉴定制度的优劣,就如何建立程序公正、便捷高效的医疗技术过失司法鉴定制度提出自己的一些可行性建议。
[Abstract]:With the rapid development of medical technology, the problems involved are becoming more and more complicated and difficult. According to Professor Yang Lixin's theory, medical negligence liability can be divided into three parts: medical product fault liability, medical ethics fault liability and medical technical negligence liability. The medical technical negligence liability is the most frequent, so this paper analyzes the duty of care in the medical technology negligence liability from the definition of medical technical negligence as a breakthrough point, comprehensive domestic and foreign successful legislation research. In order to maximize the balance of the current tense doctor-patient relationship and form a more harmonious relationship between doctors and patients, a reasonable and scientific judicial identification system of medical technical negligence should be established in order to maximize the balance between doctors and patients at the present stage. This paper is composed of the following five parts: the first part is an introduction, from the particularity of medical negligence to put forward the problem, followed by Professor Yang Lixin's point of view to lead to the research significance of medical technical negligence, for the second part of the discussion to do a good job. The second part is the theoretical overview of medical technical negligence. It mainly studies the basic problems of medical technical negligence, mainly analyzes the legal concept, characteristics, applicable scope and liability path of medical technical negligence. The third part is the duty of care of medical technical negligence, which leads to the perfection of the duty of care in the field of medical technology from the theory of duty of care in the continental law system. The logical relationship between the duty of care and the judgment standard of medical technical negligence is demonstrated. The fourth part is the judgment standard of medical technical negligence, which mainly depends on the establishment of clinical medical path to improve the standard, the standard should focus on the professional title and hospital level to distinguish the understanding and technical level of medical personnel, and at the same time, the principle of expectation. The principle of urgency and the principle of difference are used as auxiliary standards. It is proved that many factors need to be taken into account in the judgment criteria of medical technical negligence through the analysis of examples. The fifth part is the judicial identification system optimization of medical technical negligence, through comparative analysis of the advantages and disadvantages of foreign medical technical negligence appraisal system, how to establish procedural justice, The convenient and efficient judicial identification system of medical technical negligence puts forward some feasible suggestions.
