印尼网络法律制度初探——以《信息与电子交易法》为考察对象

【摘要】：随着网络技术的迅捷发展与全面适用,印度尼西亚开始在其法律体系中构建网络法律制度。2008年实施并于2016年11月修订的《信息与电子交易法》对网络犯罪、政府角色以及隐私与数据保护等做了规定,奠定了印尼网络法律制度的基础。印尼网络法律制度在理论上遵循法律构建二分法,在内容上以借鉴西方法律元素与融入本土宗教文化并重,在实践管理中呈现政府网络管理多头化等特点。当前,印度尼西亚网络法律制度还应当在内容丰富、体系规划以及立法分层等方面进一步加强与完善。
[Abstract]:With the rapid development and full application of Internet technology, Indonesia has begun to build a cyberlegal system in its legal system. The Information and Electronic transactions Act, which was implemented in 2008 and amended in November 2016, deals with cybercrime. The role of the government and privacy and data protection, etc., laid the foundation of Indonesia's cyber legal system. Indonesia's network legal system follows the law construction dichotomy in theory, in content to draw lessons from the western legal elements and integrate into the local religious culture, and presents the characteristics of government network management in practice. At present, Indonesia's network legal system should be further strengthened and perfected in the aspects of rich content, systematic planning and legislative stratification.
