房产中介违规行为的规制

【摘要】:随着我国市场经济建设逐步完善以及国家产业政策的调整,我国房产行业的得到了长足发展,与此同时,房产中介行业逐渐发展起来。房产中介行业为人们报告信息、提供媒介的服务,在市场主体的需求者和供应者之间形成信息的纽带,其在提供便捷的信息平台、促进房产市场流通的同时,也出现了各种各样的违规行为,侵害了交易双方甚至第三人的合法权益,扰乱市场经济秩序。我国房产中介市场发展滞后、混乱的主要原因就是立法的不完善,相应的配套规制机制不健全。各学科的学者从不同角度对房产中介进行了研究,有不少优秀的成果相继问世,这些理论成果为我国房产中介的发展提供了理论依据。本文通过对房产中介行业中突显的违规行为进行列举,探讨房产中介违规操作的表现形式,梳理中介活动中各方法律关系,深入研究各种违规行为的表现形式及背景成因,比较分析域外发达国家及我国台湾相关制度规定,对构建我国房产中介行业规制体系提出几点建议。希望通过自己对相关问题的探讨和分析理解,能为我国房产中介规制体系的完善,尽一点绵薄之力。第一部分从法理的角度,阐述我国房产中介服务的基本理论,分析我国房产中介服务和房产居间合同的法律定性,并简述我国房产中介的法律规范。第二部分提出我国房产市场上实际出现的违规行为,分析各种违规行为所损害的当事人合法权益以及所涉及的法律规范,简述各种违规行为带来的社会危害。第三部分从外部因素、内在因素两方面分析我国分析房产中介行业出现违规行为的背景及原因。其中包括相关法律规定、房产行业发展水平以及社会总体经济状况。第四部分以我国房产中介行业显现的问题、出现原因和背景为基础,结合美国、德国以及我国台湾地区房产中介行业的规制体系,试图对构建我国房产中介规制体系提出对策,预防和尽量减少房产中介活动中出现的纠纷,使房产中介行业日益规范化、法制化。
[Abstract]:With the gradual improvement of China's market economy and the adjustment of the national industrial policy, the real estate industry has developed rapidly. At the same time, the real estate intermediary industry has gradually developed. The real estate intermediary industry reports information, provides media services, and forms a link between the demand and suppliers of the market owners. While providing a convenient information platform and promoting the circulation of the real estate market, there are various irregularities, which infringe on the legitimate rights and interests of the two parties and even third people and disrupt the order of the market economy. The development of our real estate intermediary market is lagging behind. The main reason for the confusion is the imperfect legislation and the corresponding regulatory mechanism. The scholars of various disciplines have studied the real estate agents from different angles, and many outstanding achievements have come out successively. These theoretical results provide a theoretical basis for the development of real estate intermediaries in China. The legal relations in the intermediary activities, the in-depth study of the forms of various violations and the causes of the background, the comparative analysis of the regulations of the developed countries and the relevant regulations of Taiwan in our country, and some suggestions for the construction of the regulatory system of China's real estate intermediary industry. The first part, from the perspective of legal theory, expounds the basic theory of our country's real estate intermediary service, analyzes the legal nature of our real estate intermediary service and the property intermediary contract, and briefly describes the legal norms of our real estate intermediary. The second part puts forward the actual violation of the real estate market in our country. In the third part, the third part analyzes the background and reasons for the analysis of the illegal behavior in the real estate intermediary industry from two aspects, including the external factors and internal factors, including the relevant legal provisions, The development level of the real estate industry and the overall economic situation of the society. The fourth part, based on the problems appearing in China's real estate intermediary industry, the reasons and the background, combined with the regulation system of the real estate intermediary industry in the United States, Germany and the Taiwan area of our country, tries to put forward the Countermeasures for the construction of China's real estate intermediary regulation system, and to prevent and reduce it as much as possible. Disputes arising from real estate intermediary activities make the real estate intermediary industry more standardized and legalized.
