我国警察盘查制度研究

【摘要】：警察盘查活动具有普遍性和高效性，正是由于它对社会治安稳定所发挥的巨大作用，所以长期以来盘查得到世界各国的重视。在我国，盘查制度在实践中同样发挥了积极的作用。但盘查权在一定程度上也存在被滥用的情形，这严重影响了公民的基本权益，与我国保障人权的基本法治目标背道而驰。本文试图通过理清盘查的概念、特征、属性，深入分析实践中盘查权的使用问题，目的是为了规范警察盘查权的使用，以更好的保护公民的基本权益。笔者通过比较国外的盘查制度，结合我国国情，，对盘查的启动标准，法定程序及救济途径等方面提出了一些设想。
[Abstract]:The police inventory activity is universal and efficient. It is precisely because it plays a great role in the social security and stability that it has been attached great importance to by the countries all over the world for a long time. In our country, the system of checking has also played an active role in practice. But the right of checking is also abused to a certain extent, which seriously affects the basic rights and interests of citizens and runs counter to the basic goal of rule of law in our country to protect human rights. This paper attempts to clarify the concept, characteristics, attributes of the inventory, in-depth analysis of the practice of the use of the right to check in order to regulate the use of the police right to check, in order to better protect the basic rights and interests of citizens. By comparing the foreign inspection system and combining with the national conditions of our country, the author puts forward some tentative ideas on the starting standard, legal procedure and relief way of the inventory inspection.
