论自媒体言论自由的法律规制

【摘要】：自媒体的出现,为言论自由提供了全新的实现方式。它是公众发声的载体也是公众参加社会事务管理的媒介,对推动我国民主与法治建设,弥补间接民主的不足起到了积极的作用。但自媒体的开放性、匿名性与虚拟性等特点使有效规制自媒体言论自由的难度增大,并且自媒体言论良莠不齐,很多未经甄别的内容或非理性行为挑战社会道德底线,自媒体言论侵权、自媒体环境污染等问题接踵而来,对构建文明健康有序的自媒体空间是极大的挑战。文章在这样的自媒体时代背景下,对我国自媒体言论自由的法律规制进行全方位研究,在保障自媒体言论自由的同时,更好地规制该权利的行使,从根源上解决自媒体言论自由所衍生的问题,促进自媒体健康有序的发展。文章以保护自媒体言论自由为核心,首先对自媒体言论自由进行法理分析,理清自媒体言论自由的相关概念及特性,分析了规制自媒体言论自由的必要性,其次针对我国现行法律制度的不足,提出我国自媒体言论自由法律规制的现存问题,最后对比域外国家规制自媒体言论自由所采用的立法模式及监管体制,从完善自媒体言论自由的立法保护,增强自媒体失范言论追责制度的可操作性,建立健全自媒体言论的监管机制,加强自媒体行业建设与行业自律等四个方面提出了完善我国自媒体言论自由的法律规制的建议,以保证自媒体空间下的言论自由发挥其最大限度的价值。
[Abstract]:Since the emergence of the media, for the freedom of speech to provide a new way to achieve. It is the carrier of public voice and the medium of public participation in the management of social affairs. It plays a positive role in promoting the construction of democracy and rule of law in our country and making up for the deficiency of indirect democracy. However, due to the openness, anonymity and hypocrisy of the media, it is more difficult to regulate the freedom of speech from the media effectively, and the good and the bad are intermingled, and a lot of unscreened content or irrational behavior challenge the social moral bottom line. It is a great challenge to construct a healthy and orderly self-media space because of the infringement of media speech and the pollution of media environment. Under the background of the self-media era, the article carries on the omni-directional research to the legal regulation of the freedom of speech of the self-media in our country, in order to protect the freedom of speech of the self-media at the same time, better regulate the exercise of the right. To solve the problems arising from media freedom of speech and promote the healthy and orderly development of self-media. This paper focuses on the protection of the freedom of speech in the self-media. Firstly, it analyzes the legal principle of the freedom of speech in the self-media, clarifies the related concepts and characteristics of the freedom of speech in the self-media, and analyzes the necessity of regulating the freedom of speech in the self-media. Secondly, aiming at the deficiency of the current legal system of our country, this paper puts forward the existing problems of the legal regulation of the freedom of speech in China's self-media, and finally compares the legislative model and the regulatory system adopted by the extraterritorial countries to regulate the freedom of speech in the media. In order to improve the legislative protection of the freedom of speech of the self-media, to enhance the operability of the system of pursuing the responsibility of the self-media, and to establish and improve the supervision mechanism of the self-media speech, In order to ensure the maximum value of the free speech in the media space, the author puts forward some suggestions on how to perfect the legal regulation of the freedom of speech in China.
