枪支管理理念探析

【摘要】：枪支管理理念从根本上讲是行政管理理念,也就是行政权和公民权利的关系。当前,世界各国有两种典型模式:一是强调权力本位,否认或严格限制普通公民(猎、牧民等除外)持有枪支的权利,如中国和日本等;一是强调权利本位,保障普通公民拥有枪支的权利,如美国、也门和瑞士等。这主要是基于文化、历史传统和政治传承的不同。我国的枪支管理制度应顺应时代发展潮流,在保障公共安全价值优位的前提下,凸显尊重和保障人权的宪法精神。应在注重行政效率、行政权威,继续严格管制枪支前提下,加强民用枪支的立法,适当扩大民用枪支的配置范围,保障公民生产、生活安全和休闲、娱乐等合法权利的实现。
[Abstract]:The concept of gun management is fundamentally the concept of administration, that is, the relationship between executive power and civil rights. At present, there are two typical models in the world: one is to emphasize the power standard, to deny or severely restrict the right of ordinary citizens (except hunting, herdsmen, etc.) to hold firearms, for example, China and Japan, and the other is to emphasize the right standard. Guarantee the right of ordinary citizens to own guns, such as the United States, Yemen and Switzerland. This is mainly based on cultural, historical traditions and political heritage. China's gun control system should conform to the trend of development of the times and highlight the constitutional spirit of respecting and safeguarding human rights on the premise of ensuring the superior value of public safety. Under the premise of paying attention to administrative efficiency and administrative authority, we should strengthen the legislation on guns for civil use, properly expand the allocation scope of guns for civil use, and ensure the realization of the legal rights of citizens, such as production, life safety, leisure, entertainment and so on, under the premise of continuing to strictly control guns.
