论中小学教师惩戒行为的法律规制

【摘要】：我国现行基础教育法缺乏惩戒行为的相关具体规定,基于中小学教师教育权的权利性质以及规范教师行为、消除中小学生不合范行为的必要性,立法应明确惩戒行为的内容。鉴于实践中出现教师对未成年学生权利侵害的问题主要是源于教育法规中惩戒种类匮乏、各惩戒方式缺乏具体标准、体罚界限模糊等原因共同导致,相关立法应确定合法性、合理性和学生参与三个原则作为中小学教师实施惩戒行为的指导,同时规定言语训诫、剥夺精神奖励、收管学生物品、暂时隔离、紧急惩戒等典型的教师惩戒行为。
[Abstract]:The current basic education law of our country lacks the relevant specific provisions of disciplinary behavior. Based on the nature of the right of primary and secondary school teachers' right to education and the necessity of standardizing teachers' behavior and eliminating the unruly behavior of primary and secondary school students, legislation should clarify the content of disciplinary behavior. In view of the fact that the problem of teachers violating the rights of underage students in practice is mainly due to the lack of disciplinary types in educational laws and regulations, the lack of specific standards in various forms of discipline, and the blurring of the boundaries of corporal punishment, and so on, the relevant legislation should determine the legality. Rationality and students' participation are the guidance of teachers' disciplinary behavior in primary and secondary schools. At the same time, some typical teachers' disciplinary behaviors, such as verbal admonition, deprivation of spiritual reward, management of students' articles, temporary isolation and emergency punishment, are stipulated.
