政府采购信息披露制度探析

【摘要】：政府采购信息披露制度好比透明鱼缸,透明是政府采购阳光的关键举措。对政府采购信息披露主体的行为、信息披露方式、信息披露范围以及信息披露救济机制的合理规范,能促进采购信息及时、准确、充分、公平的披露,从而吸引广大供应商积极参与采购竞争,同时,也有助于公民对政府采购活动的监督。文章试图探析政府采购信息披露制度的基本框架,为我国信息披露制度提供可借鉴的准则。文章分四部分展开,第一部分,以政府采购制度的理论研究为基点,重点研究政府采购信息披露制度的内涵、性质、学说支撑以及价值意义。第二部分,探析政府采购信息披露的主体、信息披露方式、信息披露范围以及信息披露救济机制的基本框架。第三部分,以政府采购信息披露内容框架为准则,反思我国政府采购信息披露制度存在诸多问题,如政府采购信息披露主体权利义务的不明确,政府采购信息披露方式单一,政府采购信息披露范围的狭窄,政府采购信息披露救济途径堵塞等等。第四部分,针对我国采购信息披露制度存在问题提出具体建议,要求明确我国信息披露主体的权利与义务,改进信息披露方式,严格界定信息披露范围以及完善信息披露救济途径等。
[Abstract]:Government procurement information disclosure system is like a transparent aquarium, transparency is a key measure of government procurement sunshine. The behavior of government procurement information disclosure subject, the way of information disclosure, the scope of information disclosure and the reasonable regulation of relief mechanism of information disclosure can promote the timely, accurate, adequate and fair disclosure of procurement information. Therefore, it can attract suppliers to participate in procurement competition actively, and also help citizens to supervise government procurement activities. This paper attempts to explore the basic framework of the information disclosure system of government procurement, and to provide reference criteria for the information disclosure system of our country. This paper is divided into four parts. The first part, based on the theoretical research of government procurement system, focuses on the connotation, nature, theoretical support and value significance of government procurement information disclosure system. The second part analyzes the main body of government procurement information disclosure, the way of information disclosure, the scope of information disclosure and the basic framework of relief mechanism of information disclosure. The third part, taking the content frame of government procurement information disclosure as the criterion, reflects on the problems existing in our government procurement information disclosure system, such as the unclear rights and obligations of the subject of government procurement information disclosure, and the single way of government procurement information disclosure. The narrow scope of government procurement information disclosure, government procurement information disclosure relief channels blocked and so on. The fourth part, aiming at the problems existing in the system of procurement information disclosure in our country, puts forward some specific suggestions, which require us to clarify the rights and obligations of the subject of information disclosure in our country, and to improve the way of information disclosure. Strictly define the scope of information disclosure and improve the relief ways of information disclosure.
