公用企业信息公开问题研究

【摘要】:随着公共行政的不断发展,传统的行政机关行政模式悄然发生变化,越来越多的社会组织进入公共行政领域,承担起为公众提供公共服务的角色。社会组织进入公共行政领域,虽然适应了我国深化行政体制改革的需要,提升了公共服务的质量与水平,但是也对信息公开制度带来了挑战。信息公开制度建立的初衷是为了规范行政权力运行,维护公民知情权,但是随着社会组织进入公共服务领域,致使公共服务领域内的行政机关在信息公开视野下悄然消失。公用企业进入公共行政领域承担起为社会公众提供公共服务的职能,同时也应当肩负起信息公开的义务。但是我国相关法律法规对公用企业信息公开问题的规范并不完善,导致人们获取公用企业信息困难重重,公民的知情权得不到有效保障。完善公用企业信息公开不仅有助于规范公用企业运营,促进公共服务水平的提高,而且还有助于保障公民知情权。如何完善公用企业信息公开制度是本文所努力研究的方向,为此,文章从以下几个方面展开论述:公共行政民营化促使私法主体进入公共行政领域,承担起为社会公众提供公共服务的职能,肩负起信息公开的义务。只有了解公共行政民营化,才能更好地理解公用企业信息公开。行政法理论依据是探讨公用企业信息公开问题的基础,对公用企业信息公开的行政法理论介绍可以明确公用企业信息公开在行政法制度中的重要作用。而对相关法律法规的梳理则有助于我们了解有关公用企业信息公开的相关规定。回归到公用企业本身,完善公用企业信息公开对于促进公用企业自身以及公用事业的发展具有十分重要的意义。《政府信息公开条例》第37条作为规范公用企业信息公开的直接依据,对该条款的解读,有助于促进公用企业信息公开的实施。第37条居于附录部分,对《政府信息公开条例》的实施起着不可替代的作用。第37条用“参照”一词将该条款与整个行政法规联系在一起,从而确认了公共企事业单位的信息公开义务。“参照”一般表明一个授权结果,赋予公共企事业单位在实施信息公开活动时可以变通执行《政府信息公开条例》的相关规定。公用企业如何参照《政府信息公开条例》实施信息公开活动,是促进公用企业信息公开与保障公民知情权的关键。了解公用企业信息公开实施的不足有助于我们更加清醒地认识到公用企业信息公开实施现状,从不足出发更加有助于完善公用企业信息公开。公用企业信息公开实施的不足之处主要体现在:公用企业信息公开法律制度不完善、信息公开与保护商业秘密之间难以权衡、行政主体理论限制了公用企业信息公开的救济途径。发现问题的目的在于解决问题。针对公用企业信息公开的不足,文章首先从比较法的角度介绍了域外的相关经验,提出了对完善我国公用企业信息公开的借鉴意义。然后从法律法规的整合、商业秘密范围的重新界定等方面入手,探讨了如何完善公用企业信息公开法制建设。针对公用企业信息公开监管力度不足的问题,从完善政府监管与加强社会监督两个方面相结合,加强对公用企业信息公开的监督。最后文章探讨了如何完善公用企业信息公开的救济制度,从理论上要明确公用企业的主体地位,赋予其行政主体地位,在实践层面要强化对公用企业信息公开的司法审查。
[Abstract]:With the continuous development of public administration, the traditional administrative mode of administration has changed quietly. More and more social organizations have entered the field of public administration and assume the role of providing public service for the public. The social organization has entered the field of public administration, although it has adapted to the needs of the reform of the deep administrative system in our country and promoted the public service. Quality and level, but also bring challenges to the information disclosure system. The original intention of the establishment of information disclosure system is to standardize the operation of administrative power and maintain the right to know the citizens, but as social organizations enter the field of public service, the administrative organs in the field of public service disappear quietly in the field of information disclosure. Public enterprises enter into the public service field. In the field of public administration, it assumes the function of providing public service for the public, and it should also shoulder the obligation to open the information. However, the relevant laws and regulations of our country are not perfect in the standardization of public enterprise information disclosure, causing people to obtain the heavy heavy information of public enterprise information, and the citizens' right to know can not be effectively guaranteed. Public enterprise information disclosure will not only help to standardize the operation of public enterprises, promote the improvement of public service level, but also help to guarantee the right to know the citizens. How to improve the public enterprise information disclosure system is the direction of this paper. The article discusses the following aspects: privatization of public administration encourages private law owners In the field of public administration, the body assumes the function of providing public service to the public and shouldering the obligation to open information. Only by understanding the privatization of public administration can the public enterprise information be better understood. The theoretical basis of the administrative law is to discuss the basis of public enterprise information open questions and the public administration of public enterprise information. The introduction of legal theory can clarify the important role of public enterprise information disclosure in the administrative law system. The combing of relevant laws and regulations will help us to understand the relevant provisions concerning public enterprise information disclosure. Return to the public enterprise itself, improve public enterprise information disclosure to promote public enterprises themselves and public utilities. The development of the "government information disclosure regulation > thirty-seventh" as the direct basis for the standardization of public enterprise information disclosure will help to promote the implementation of public enterprise information disclosure. The thirty-seventh article is in the appendix part and plays an irreplaceable role in the implementation of the regulations of the government information disclosure. Thirty-seventh articles are used. The term "reference" links the clause to the whole administrative regulation, which confirms the disclosure obligation of public enterprises and institutions. "Reference" generally indicates a result of authorization, which gives public enterprises and institutions to implement the relevant regulations of the "Government Information Disclosure Ordinance" in the implementation of information disclosure activities. How to refer to the government information disclosure regulation is the key to promote public enterprise information disclosure and to guarantee the right to know the citizens' information. To understand the lack of public information public implementation is helpful for us to realize the present situation of public enterprise information disclosure more clearly, and to improve the public enterprise from the lack of starting point. Information disclosure. The shortcomings of public enterprise information disclosure are mainly manifested in: public enterprise information disclosure legal system is imperfect, information disclosure and protection of business secrets are difficult to weigh, the administrative subject theory restricts the public enterprise information relief ways. The lack of information disclosure, the article first introduces the relevant experience from the perspective of comparative law, and puts forward the significance of improving the information disclosure of public enterprises in China. Then, from the integration of laws and regulations and the redefinition of the scope of business secrets, this paper discusses how to improve the construction of public enterprise information public legal system. With the lack of public supervision of enterprise information, the supervision of public enterprise information disclosure is strengthened from two aspects: perfecting the government supervision and strengthening the social supervision. Finally, the article discusses how to improve the relief system of public enterprise information disclosure. In theory, it is necessary to confirm the main position of the public enterprise and give its administrative body. At the practical level, we should strengthen judicial review of information disclosure of public enterprises.
