我国物业管理中若干法律问题研究

【摘要】:物业管理作为一个新兴产业伴随着房地产经济的快速发展而逐渐形成了自己的行业规模。商品房的开发和城市小区的增多对物业服务提出了更高的要求,但由于我国物业管理起步较晚、相关的法律制度不完善,在时有发生的物业管理纠纷中,物业管理法律法规显得捉襟见肘。本文针对目前我国物业管理中存在的法律问题进行研究,在已有物业管理理论的基础上结合我国的物业管理实践,通过分析我国的物业管理立法及结合国外的物业管理立法,针对我国物业管理中的突出问题提出完善我国物业管理的立法构想。期望对我国物业管理立法制度的完善起到一定的参考意义。 本文共分四个部分,第一部分是物业管理的理论基础,主要介绍物业管理的基本知识及我国物业管理的概况。第二部分是我国物业管理中突出法律问题的分析,这一部分是全文的核心所在,主要从小区停车位权属的界定、物业费收取、物业管理法律关系的厘定等几个方面来分析我国物业管理中存在的问题及其成因。第三部分是物业管理制度的域外考察。相比较于我国物业管理的法律制度,国外的法律制度发展较早也相对完善,对我国物业管理的完善有很大的借鉴意义。第四部分是构建我国物业管理法律制度的几点构想。通过第二部分对我国物业管理制度存在的法律问题的分析及第三部分的国外考察,在基于我国物业管理实践的基础上借鉴国外好的制度,针对我国物业管理法律制度的完善提出自己的几点构想。
[Abstract]:Property management as a new industry with the rapid development of real estate economy has gradually formed its own industry scale. The development of commercial housing and the increase of urban residential areas put forward higher requirements for property services. However, due to the late start of property management in China, the relevant legal system is not perfect, in the property management disputes that occur from time to time. Property management laws and regulations appear to be overstretched. This paper studies the legal problems existing in the property management of our country at present. On the basis of the existing property management theory, it combines the property management practice of our country, through the analysis of the property management legislation of our country and the property management legislation of foreign countries. Aiming at the outstanding problems of property management in our country, this paper puts forward the legislative conception of perfecting property management in our country. It is expected to play a certain reference significance to the perfection of the legislation system of property management in our country. This paper is divided into four parts, the first part is the theoretical basis of property management, mainly introduces the basic knowledge of property management and the general situation of property management in China. The second part is the analysis of the outstanding legal problems in the property management of our country. This part is the core of the full text, mainly from the definition of the ownership of parking spaces in residential areas and the collection of property fees. This paper analyzes the problems and causes of property management in China. The third part is the extraterritorial investigation of property management system. Compared with the legal system of property management in our country, the legal system of foreign countries developed earlier and is relatively perfect, which is of great significance for reference to the perfection of property management in our country. The fourth part is the construction of China's property management legal system several ideas. Through the analysis of the legal problems existing in the property management system of our country in the second part and the foreign investigation in the third part, the author draws lessons from the good foreign system on the basis of the property management practice in our country. In view of our country property management legal system consummation puts forward own several ideas.
