我国官员财产申报公开制度建构研究

【摘要】：官员财产申报公开制度其主要核心内容是要求官员按照规定向主管部门申报自己的财产并且将此内容向全社会公开,接受主管部门、广大群众和社会团体的监督。这一制度确保了官员财产的真实性与合法性,从而保证官员的廉洁性及政府内部的有序运行,达到真正的职责统一,为人民服务。实际上,官员财产申报公开制度是防治与预防腐败的最有效方法之一,能够震慑防止官员行政权力的滥用,同时此制度有利于增强政府的公信力,塑造良好的公众形象。可是目前这项具有重要作用的制度在我国一直未能确立起来,追究其未能确立与实施的深层次原因与我国的社会性质,历史传统,法律制度等有着密切关系。现在我国已经出现的官员腐败,官员权力滥用,干部与群众关系紧张,法律权威性被削弱等严峻问题,我国必须尽快建构出官员财产申报公开制度并且实施。本文以马克思主义法学观作为指导思想,主要用文献研究方法、比较研究法、实证分析等方法,选择我国具有代表性的官员财产申报公开制度地方试点和其他国家及地区成熟的相关制度,了解其具体内容、成因、经验、不足、启示等。从行政法理论的视角,将法学理论联系实际,将理论与我国实际情况相结合,以现有资料为支撑,建构符合我国国情的官员财产申报公开制度。本文以官员财产申报公开制度对我国具有重要意义为前提,从官员财产申报公开制度未能确立的主要原因、推行的困境为切入点,导出官员财产申报公开制度在我国建立的可行路径。同时吸取地方和其他国家及地区的成功经验,进而详细论述此制度在我国建构中的应当包括涵盖的主要内容。最后设计的配套制度措施也是为了保证此制度在建构完善后能够在我国的政治环境、社会环境、法治环境中顺利推行,并起到应该有的巨大作用。笔者相信,我国的国情需要建构明确的官员财产申报公开制度,一旦官员财产申报公开制度确立,必将很快在我国实施推广,并且相关配套的制度及法律法规也会随之出台。这将很大程度上强化公民监督的权利,促进我国廉政建设,完善社会主义监督体系,促使我国走出了一条有中国特色的防治与预防腐败的道路,也为今后更好地坚定不移地建设中国特色社会主义法治社会打下了稳定基础。
[Abstract]:The main content of the official property declaration and disclosure system is to require officials to declare their property to the competent department according to the regulations and to make this content public to the whole society, and accept the supervision of the competent department, the broad masses and social organizations. This system ensures the authenticity and legitimacy of official property, thus ensuring the integrity of officials and the orderly operation of the government, so as to achieve the real unity of responsibility and serve the people. In fact, the disclosure system of official property declaration is one of the most effective ways to prevent and prevent corruption, which can deter the abuse of administrative power of officials. At the same time, this system is conducive to strengthening the credibility of the government and shaping a good public image. However, at present, this important system has not been established in our country. The deep-seated reasons for its failure to establish and implement are closely related to the social nature, historical tradition and legal system of our country. At present, there are serious problems such as official corruption, abuse of official power, tension between cadres and masses, weakening of legal authority, and so on. Our country must construct and implement the system of official property declaration and disclosure as soon as possible. This paper takes the Marxist view of law as the guiding ideology, mainly using the methods of literature research, comparative research, empirical analysis, etc. Select the representative local pilot system of official property declaration and other countries and regions mature related system, understand its specific content, causes, experience, deficiencies, enlightenment and so on. From the perspective of the theory of administrative law, this paper combines the theory of law with practice, combines the theory with the actual situation of our country, and constructs the system of official property declaration and publicity according to the national conditions of our country, which is supported by the existing information. Based on the premise of the important significance of the official property declaration disclosure system to our country, this paper starts with the main reasons for the failure to establish the official property declaration disclosure system, and the difficulties in the implementation of the system. The feasible path of establishing the open system of official property declaration in our country is derived. At the same time, drawing on the successful experiences of local and other countries and regions, this paper discusses in detail the main contents that should be included in the construction of this system in our country. Finally, the supporting system measures are designed to ensure that the system can be carried out smoothly in the political environment, social environment and rule of law environment of our country after the construction and perfection of the system, and play a great role in it. The author believes that the national conditions of our country need to construct a clear open system of official property declaration, once the official property declaration and disclosure system is established, it will soon be implemented in our country, and relevant systems and laws and regulations will be issued. This will, to a large extent, strengthen the right of citizens to supervise, promote the building of a clean and clean government in our country, perfect the socialist supervisory system, and prompt our country to take a path of preventing and preventing corruption with Chinese characteristics. It will also lay a stable foundation for building a socialist society ruled by law with Chinese characteristics.
