我国劳动争议仲裁制度存在的问题及完善

【摘要】:随着市场化、城镇化、全球化的进程不断加快,我国劳动用工形式日趋多样,劳动关系愈发的复杂多变,劳动争议案件呈现出总量大、速度快的态势。2008年《中华人民共和国劳动合同法》实施,各级劳动仲裁委员会立案受理的劳动案件达近70万件,是2007年35万件的2倍,并有不断增长的趋势。劳动争议案件的激增导致各级劳动争议调解和仲裁机构办案压力越来越大,案多人少的矛盾也进一步突出。劳动案件当事人之间的利益冲突很容易被激化,尤其是集体劳动争议案件,涉及到当事人数量众多,处理不当,极易诱发上访、闹访、群访等不稳定因素,引发社会矛盾,影响社会稳定。为了解决矛盾,各级政府出台了各种应对方案,不断将仲裁纠纷解决权力下放至各乡镇、街道办事处,成立调解庭、派出庭,这在一定程度上虽然缓解了办案压力,但仲裁的专业性、权威性不断受到挑战。调解庭、派出庭等各项制度亦急需改进和完善。因此,研究和改善劳动争议仲裁制度具有重要的实践意义。本文试图通过三个部分对劳动争议仲裁机制展开论述。第一部分主要对劳动争议仲裁制度做一个现状分析。首先,阐述劳动争议仲裁的制度运行状况,对劳动争议仲裁的概念进行论述。通过分析学界现有的的观点和学说,并提出自己的观点。其次,根据我国目前关于劳动争议仲裁的一系列规定,对我国劳动争议仲裁制度的基本内容进行概括介绍。最后,通过数据采集,对全国和宁波市奉化区案件情形进行分析,从宏观和微观两个方面来论述劳动争议仲裁制度的实践运行。第二部分提出我国劳动争议仲裁机制存在的问题。主要联系仲裁实务,从我国劳动争议机构性质缺陷、仲裁员的素质难以保证、仲裁程序不完善、裁决标准的不统一、裁判标准的不统一、行政权与司法权行使的界限不明、仲裁监督机制不健全、仲裁员队伍稳定性欠缺、调查取证权缺乏、“一裁终局”案件在实践中的运用范围等问题来分析提出自己的观点。第三部分提出自己关于劳动争议仲裁机制改革的构想。主要结合第二部分提出的具体问题,总结归纳出相应的改革方案,对立法规定的健全和完善、管理仲裁员的相关制度、劳动争议仲裁监督制度、劳动争议仲裁机构的改建等提出初步改革的构想。
[Abstract]:With the development of marketization, urbanization and globalization, the labor employment forms are becoming more and more diverse, the labor relations are becoming more complex and changeable, and the total amount of labor dispute cases is large. In 2008, the Labor contract Law of the people's Republic of China was put into effect, and the number of labor cases filed and accepted by labor arbitration committees at all levels reached 700000, twice as many as 350000 in 2007, with a growing trend. The surge of labor dispute cases leads to more and more pressure from labor dispute mediation and arbitration institutions at all levels. Conflicts of interest between the parties involved in labor cases are easily intensified, especially in cases of collective labor disputes, which involve a large number of parties, are improperly handled, and can easily lead to unstable factors, such as petitions, visits, group visits, and so on, leading to social contradictions. Affect social stability. In order to resolve conflicts, governments at all levels have issued various coping plans to continuously decentralize the power of arbitration dispute resolution to various townships, subdistrict offices, mediation courts, and dispatch courts. This to a certain extent alleviates the pressure of handling cases. However, the professionalism and authority of arbitration are constantly challenged. Mediation court, dispatch court and other systems also need to be improved and improved. Therefore, it is of great practical significance to study and improve the labor dispute arbitration system. This paper tries to discuss the arbitration mechanism of labor dispute through three parts. The first part mainly analyzes the current situation of labor dispute arbitration system. Firstly, it expounds the system of labor dispute arbitration and discusses the concept of labor dispute arbitration. Through the analysis of the existing views and doctrines of the academic community, and put forward their own views. Secondly, according to a series of regulations about labor dispute arbitration in our country, the basic content of labor dispute arbitration system in our country is introduced. Finally, through the data collection, this paper analyzes the cases in Fenghua District of China and Ningbo City, and discusses the practical operation of labor dispute arbitration system from the macro and micro aspects. The second part puts forward the problems existing in the mechanism of labor dispute arbitration in China. Mainly related to the arbitration practice, from the nature defects of the labor dispute organization in our country, the quality of the arbitrators is difficult to guarantee, the arbitration procedure is not perfect, the standard of the award is not unified, the standard of the adjudication is not unified, the boundary between the executive power and the judicial power is not clear. This paper analyzes and puts forward its own views on the imperfect mechanism of arbitration supervision, the lack of stability of the arbitrators, the lack of the right to investigate and collect evidence, and the scope of application of the case of "one final award" in practice. The third part puts forward my own idea about the reform of labor dispute arbitration mechanism. Combined with the specific problems raised in the second part, the author summarizes and summarizes the corresponding reform plans, the perfection and perfection of the legislative provisions, the related system of managing arbitrators, the supervision system of labor dispute arbitration, The reconstruction of labor dispute arbitration institution and so on put forward the idea of preliminary reform.
