保密监督程序研究

【摘要】：《中华人民共和国保守国家秘密法》(以下正文简称《保密法》)与《中华人民共和国保守国家秘密法实施条例》(以下正文简称《保密法实施条例》)的规定,初步确立了我国的保密监督程序。保密监督程序,是指保密行政管理部门或其他负有保密管理职责的行政机关对在对有义务保守国家秘密的组织和个人实行监察和管理,督促其履行义务的行为过程中所必须遵循或履行的法定时间和空间上的步骤和方式,与其上位概念行政监督相比,保密监督程序既有共性,也有特性,从特性角度看,保密监督程序在主客体、性上、程序的严密度、监督的方式以及公开程度上具有自身之特性。保密监督程序的确立,具备坚实的理论基础与实践需要,从《保密法》与《保密法实施条例》的规定来看,其明确了保密监督程序包含定密监督、保密检查、泄密案件查处与处分监督等程序。就保密监督程序的缺陷及成因分析上看,其在保密监督程序的启动、运行及终止阶段均存在一定的瑕疵,具体包括定密监督、解密监督等；这些缺憾,主要源于现有保密监督程序在观念层面和制度层面上的不足与缺憾；就保密监督程序的应然对策来看,基于对既有问题的分析,在理顺保密与公开关系及现有的原则性规定基础上,有必要在具体制度上予以进一步的丰富和完善,包括建成双向信息收集机制,完善定密监督程序、构建解密监督程序与争端解决机制。
[Abstract]:The provisions of the People's Republic of China conservative state secret law (hereinafter referred to as the text of the secrecy law) and the regulations for the implementation of the secrecy law of the People's Republic of China (hereinafter referred to as the implementation of the secrecy law) have preliminarily established the procedures for the supervision of the secrecy in our country. The confidential supervision process refers to the secrecy administrative department or others. The administrative authority of the secret management functions to supervise and manage the organizations and individuals who have the obligation to keep the state secret, and to supervise and urge them to comply with their obligations in the process of taking or performing the legal time and the steps and ways in the space. Compared with the superordinate concept of administrative supervision, the procedures for supervision of secrecy are both common and characteristic. In terms of characteristics, secrecy supervision procedures have their own characteristics in the subject and object, the tightness of the procedure, the way of supervision and the degree of openness. The establishment of the confidential supervision procedure has a solid theoretical basis and practical needs. From the provisions of the secrecy law and the implementation regulations of the secrecy law, the confidential supervision procedures include the definition of the secrecy supervision procedure. There are some defects in the start, operation and termination of the secret supervision procedure, including the fixed supervision, the decryption supervision, and so on. These defects mainly originate from the existing confidential supervision procedures in the concept. In terms of the deficiencies and shortcomings in the level and system level, based on the analysis of the existing problems, based on the analysis of the existing problems, the need for further enrichment and improvement on the basis of the confidentiality and public relations and the existing principles, it is necessary to further enrich and improve the specific system, including the completion of a two-way information collection mechanism, and the improvement of the fixed supervision system.
