我国社会组织及其立法问题的思考

【摘要】：由于我国过去特有的经济体制,国内社会组织的发展和国家对于社会组织的管理呈现出我国自身独有的特点。一方面,社会组织本身存在不少困境,如发展不平衡,职能定位混乱等;另一方面,在立法层面有关社会组织的立法少之又少,且立法层次低,双重管理模式等。而随着国家对社会组织的重新认识和定位,这些问题的顺利解决成为社会组织健康发展的当务之急,所以进行社会组织立法成为解决问题的关键。立法是对社会问题的反应,只有先准确找出问题,才能正确解决问题。对我国社会组织进行立法的制度设计与安排,可以使社会组织在正快速转型和深刻变革的当代中国,发挥巨大的积极作用。所以论文由我国社会组织发展的自身特征入手,综合分析我国社会组织出现的问题,从宏观层面分析了如何建立健全完善的社会组织法律体系,从微观层面分析了我国社会组织法总则和分则角度的一些具体法律问题,并提出了一些可行的对策建议,以期有益于我国社会组织的发展。
[Abstract]:Because of the unique economic system in the past, the development of domestic social organizations and the management of social organizations in China have their own unique characteristics. On the one hand, there are many dilemmas in the social organization itself, such as unbalanced development, confused function orientation and so on; on the other hand, there are very few legislations about social organization in the legislative level, and the legislative level is low, and the dual management mode is also low. With the new understanding and orientation of social organizations, the smooth solution of these problems becomes the urgent task of the healthy development of social organizations, so legislation on social organizations becomes the key to solve the problems. Legislation is a response to social problems. Only by finding out the problem accurately can we solve the problem correctly. The system design and arrangement of legislation on social organization in our country can make social organization play a great positive role in the contemporary China which is undergoing rapid transformation and profound change. So the thesis starts with the characteristics of the development of social organization in our country, analyzes the problems of social organization in our country synthetically, and analyzes how to establish and perfect the legal system of social organization from the macro level. This paper analyzes some specific legal problems of the general principles and sub-rules of the social organic law in China from the micro level, and puts forward some feasible countermeasures and suggestions in order to benefit the development of the social organization in our country.
