解读《慈善法》:过程、内容、亮点与问题

【摘要】：新中国的第一部《慈善法》,不仅其立法过程充分体现了科学民主立法的总方针,而且所构建的制度内容足以支撑其基本法的地位。众多的立法亮点彰显了我国对慈善事业的诸多新理念、新判断以及新思路,但由于受我国立法所处阶段等的限制,也存在不少法律制度构建方面的问题,这些问题同样突显当下我国立法所普遍存在的不足,需要从提高整体立法水平和质量的高度加以解决。
[Abstract]:The first "charity law" of new China, not only its legislative process fully embodies the general policy of scientific and democratic legislation, but also the system content is sufficient to support the status of its basic law. Many of the legislative highlights highlight many new ideas, new judgments and new ideas of our country to philanthropy, but because of the stage of our country's legislation, etc. There are also many problems in the construction of legal system. These problems also highlight the shortcomings of the current legislation in our country and need to be solved from the high level of the overall legislative level and quality.
