网络信息安全的法制研究

【摘要】：网络的飞速发展使得网络信息安全的保障已成为当前世界各国的重大课题。信息网络发展的宏观经济环境和法制环境是衡量信息网络安全的首要指标,因此,构建以法律保障为核心的保障网络信息安全的法制体系已成为世界各国的共识。随着我国社会信息化进程的加快,基础网络和重要信息系统等基础设施基本建成,信息产业成为国民经济第一大支柱产业,网络在促成人类生产和生活革命性变革的同时,也引发了各种对国家、社会、企业、个人安全的威胁,其中包括个人信息保护和隐私权保护,商业信息安全、企业公平竞争权和名誉权的保护。网络信息安全保护不周,既不符合充分保障个人权益的法治要求,也成为阻碍电子商务发展的巨大障碍。因此我国当前信息安全立法中必须确认不同主体的法律地位,规定不同主体对其信息资料所享有的权利和义务、网络身份认证制度、对网络信息收集、使用和转移规定严格的条件和程序、在网络信息安全中应承担的法律责任等事项。此外,还要对当事人权利遭到侵害时的救济途径、对侵害网络信息安全的违法行为的制裁标准等给予明确的规定。信息技术发展很快,覆盖面广,保证网络信息安全也会越来越困难,而一旦网络信息被利用或攻击,其影响和损失也将更大。针对这种现状和这些问题的存在,研究网络信息安全的立法保障便显得极有必要。笔者在一定研究和分析的基础上,选择了此题目作为自己的毕业论文,希望通过自己的论述,对网络信息安全立法的调整对象及不同主体在网络信息安全立法中的法律地位等问题进行研究与分析,结合中国网络信息安全的立法现状与现实问题,借鉴西方其他国家的相关立法经验,以思考与探索我国未来网络信息安全法律制度的相关问题。
[Abstract]:With the rapid development of network, the guarantee of network information security has become a major issue all over the world. The macroeconomic environment and legal environment of the development of information network are the primary indicators to measure the security of information network. Therefore, it has become the consensus of all countries in the world to construct a legal system to guarantee network information security with the core of legal security. With the acceleration of the information process in our country, the basic network and important information system infrastructure have been built, and the information industry has become the first pillar industry of the national economy. While the network has brought about revolutionary changes in human production and life, the information industry has become the first pillar industry of the national economy. It also causes a variety of threats to national, social, corporate and personal security, including the protection of personal information and privacy, the security of business information, the right to fair competition and the right to reputation. The inadequate protection of network information not only does not meet the rule of law requirement of protecting individual rights and interests fully, but also becomes a huge obstacle to the development of electronic commerce. Therefore, in our country's current information security legislation, we must confirm the legal status of different subjects, stipulate the rights and obligations of different subjects to their information materials, network identity authentication system, and collect network information. Use and transfer of strict conditions and procedures, in the network information security should bear legal responsibility and other matters. In addition, there are also clear provisions on the remedies for the infringement of the rights of the parties and the sanction standards for the illegal acts that infringe the network information security. With the rapid development of information technology and wide coverage, it will be more and more difficult to ensure the network information security. Once the network information is used or attacked, its impact and loss will be greater. In view of this situation and the existence of these problems, it is very necessary to study the legislative guarantee of network information security. On the basis of certain research and analysis, the author chooses this topic as his graduation thesis, hoping to pass his own exposition. This paper studies and analyzes the adjusting object of network information security legislation and the legal status of different subjects in network information security legislation, and combines the current legislative situation and practical problems of network information security in China. Using the relevant legislative experience of other western countries for reference, this paper tries to consider and explore the related problems of our country's future network information security legal system.
