困境与路径:价值评估标准探析——立法评估的视角

【摘要】：立法评估在我国立法实践中已经展开。价值具有天然的评判功能,能够成为立法评估的重要标准。价值评估在立法评估理论中存在有难以客观化和难以量化的困境。理性是价值评估标准确立的基础,定性是价值评估标准确立的尺度。价值评估标准的具体确立需要通过寻求公度性价值理念、公开理性论辩、建立合理论证规则等环节。
[Abstract]:Legislative evaluation has been carried out in the legislative practice of our country. The value has the natural judgment function, can become the legislation appraisal important standard. In the theory of legislative evaluation, value evaluation is difficult to be objective and difficult to quantify. Rationality is the basis of the establishment of the value evaluation standard, and the nature is the yardstick of the value evaluation standard. The concrete establishment of the value evaluation standard needs to seek the public value idea, open the rational argument, and establish the reasonable argumentation rule and so on.
